It might be up to the different states. Back in MD they had off road LSD and you could tell the difference since it would smoke more and your MPG would go up. They might have changed it all now, Im not sure.
I used to do snow removal work for a guy who owned a landscape company back In MD, and he was the one who told me about all off road being ULSD by 2010. He wasnt sure some of his older equipment would run one it..
during our cat trainning we were told the older engines would run fine on ulsd, scary part is that we are seeing alot of injector failures in the 3126, c7 engines since the change, another note the new ulsd engine do not run well on lsd. the biggest problem i have seen on the newer engines run on lsd is turbo failure, not sure why but the turbo wheels are coated in white ash when run on lsd
You can still get on road LSD. Its not till 2010 that all on-road fuel will be required to be ULSD. I know I've seen a few truck stops that still sell LSD. Check their online prices and it will list the type of fuel. Here's TA Travel Centers and Flying J.
In some places if you have over 20 gallons of O.R diesel in your truck they will try and charge you with tax evasion.... Which is a federal offense and will put u in federal prison with federal fines...

Its not the exact same, I believe its the low sulfur stuff now and then in 2010 it will all be ultra low sulfur, on road and off. Unless they have changed it since last time I checked.
it all depends on the state. here in New Jersey, all fuel is ulsd. the only difference is off road is dyed red to show no road use tax was paid on it.

Running "off road" fuel is illegal because of the no tax thing. The penalty is very steep as a deterrant due to how hard it actually is to catch any one individual.

One ounce of red fuel will color 100 gallons of fuel. I once ran out of fuel in my Kenworth log truck-driving in 6-8 inches of snow and slush for almost 150 miles and my fuel mileage dropped to about 3.2 mpg. Any ways, I ran out of fuel about 10 miles from the station where I was to get fuel. The guy who rescued me only had red fuel, so I put in just enough to get to the station. Long story short is the red fuel stained my regular diesel for almost three weeks until I finally purged it all out of the tank and changed all the filters and cleared the lines. The DOT check stations wouldn't care how the fuel got in the tank, just that it is red, so I had to do something to get it out.

I think the better question is whether you can afford to be a tax cheat or not. If you can, go for it. If not, don't. IOW, if I get caught, do I have the money set aside to pay the fine or will I have to go out on the streets and be a gay male prostitute to pay the fine.

The question is whether it is fair for me to pay my taxes for the road damage I caused while you can wreck the roads without paying for them. The dyed fuel is for farmers who don't drive their appliances on the road and should be exempt since they don't.
I understand where you would assume that and theres most likely some truth behind your thesis there. However I am not a believer that the tax on fuel is strictly only used for highway maintenance, secondly I do not believe that its the only source of funding for road upkeep. As far as i know, part of a persons property taxes go into upkeep of the roads within the municipality of which they are paying property tax in.
So now the question is, if i did not drive, would the government lower my property tax accordingly? 99.999% unlikely. So now onto your method of reasoning, is it fair that people who do not drive are also paying to keep up the roadways you and I drive on? Not at all.
one more thing, road maintenance? haha i hope yours are kept better than here. Winter roads suck here, always covered with packed snow and ice, highways get plowed a couple days later etc.
I dont vote, because I dont want my hard earned money to contribute to any ball sack politicians overly excess yearly salary.

In Louisiana the first few weeks after Katrina 95 % of the stations were out of fuel. The presidential disaster area allowed flexability on fuel. We ran (but bought at the pump with the tax applied) Red off road diesel because that is all the fuel that was available. The red fuel ran no differnet than normal fuel. NOTE All taxes were paid at the pump, so there was no fraud here just trying to help out people in the disaster area. We even had rescue boats running out of fuel it was so critical. So how does Red run compared to normal. no difference.

The real kicker a while back a guy had a bumper sticker basically saying running on peanut oil. He was ticketed for making his own fuel and not paying road tax.
Red diesel and clear diesel used to be the same thing, but now red is low sulfur and clear is ULSD (till 2010 when both will be ULSD). Some places still sell LSD for on road use (and its clear). Any type of dyed fuel does not have taxes applied to it, so it can only be used off road or for heating purposes.
