STARKE, Fla. (AP) -- A man facing execution Tuesday for raping and murdering an 11-year-old boy is making a last-ditch effort to get a stay from the U.S. Supreme Court, saying Florida's lethal injection procedures can cause severe pain and suffering.
Mark Dean Schwab's attorneys filed the appeal Monday night, less than 24 hours before the scheduled 6 p.m. execution for the 1991 slaying of Junny Rio-Martinez. The Supreme Court last spring upheld Kentucky's lethal injection procedure, but Schwab's attorneys are citing Florida's botched execution of Angel Diaz in December 2006.
The needles missed Diaz's veins and it took 34 minutes for him to die, more than twice the normal time.
"Florida is a state with a long history of failed and disconcerting executions," Schwab's appeal said.

the only thing that i wish they could change about execution in this country is to harvest the good organs so that decent people that are just dealt a band hand when it comes to health could live with the transplants
as it should be, I miss the electric chair my self. i would always turn my lights off to ensure enough juice for them
Power for electrocutions in many places (if not all) use their own generators. The electric companies early own didn't feel it morally right for them to supply power to kill someone. Plus, with their own generators, there is less chance of failure from overloads. I don't know if that changed later or not. jd
The worst part is that this guy was already in prison for raping a child but got out early due to good behavior.
Thanks to this crime, now Florida has the Junny Rio-Martinez Law, preventing child sex offenders from getting early release for any reason.
It's a shame it took this long to get the job done, but it's over with now. Hopefully the family can have some closure. At the very least he won't be hurting anyone again.
they say that alot of victims feel guilty the guy is executed cause they pressed charges but beyond that i think its better for society the fool will never hurt any other kid again period
it was more of a joke then anything else...but didnt texas pass a law that says if like 3 or more people see you do it then you get killed faster? dont remember where i heard that though...
i cant believe the supreme ct didnt pass the law for execution against crimes like these.
and this thread is a perfect example of the injustice that the system is doing to these victims, by giving the monstrous perps another chance to do it again.
missing vt 12 year old girl we have going on right now. she has an uncle thats a registered sex offender and the last one to see her. hmmmmmmmm, well heres another perp thats out on the street and possibly even commited this crime. worst part its a family member like alot of cases. theyve also arrested the stepfather as well i believe.
sad to say but im sure the girl is gone,and was raped prior to it
its in there blood,i cant say it enough times.........theres no rehab when you have a sexual urge that you cant control,especially when the urge is geared towards children
