layed off during winter

layed off during winter

Today my dad got called back into work from the usual winter layoff(Construction) When he went in today they had a newly hired employee that has been working a few weeks. Now don't they have to call back all layed off employees before they can hire any new employees? My dad was unsure of this and I told him Id ask around. Thanks

Depending on what they had the new employee doing. He could have been in training and maybe they wanted to start him early as to get his feet wet before all the experienced workers returned.

Union? Take it up with the union rep. If not union, there's nothing keeping an employer from doing whatever the heck they want.

If it's Union, contact Rep and file grievances for time lost, most collectives state all employees need to be called back before any new hire.

its not a union job. He was just under the impression that all layed off workers must be called back before they hire anyone new.

I would think and hope that they would call back the old employees before getting new ones......Least that is how most good contractors around here do it.

well that would be the ethical thing to do if he is a valued employee, but that's at the company's discretion without a collective agreement in effect, as long as things are done within the labor laws anyway, and to some " fly by night" construction companies labor laws are meaningless unless a complaint is filed..
