Would the people that administer the sniffer test know that it only came with a 2v carb and would they fail me on the inspection.

You can still get the EGR plates from Ford AFAIK (part #E4ZZ9A-589E) but E'brock makes them as well. If you got the Performer 400 EGR manifold you could still mount the old 2V carb on it with the 2V EGR spacer that comes with the intake and pass the sniffer as well as the visual since that intake with the 2V carb is considered a "street legal replacement part" for the factory manifold. If you're in CA you're taking a chance trying to pass the visual with a 4V carb. If you get caught the worst they can do is make you put the 2V back on it and re-test. They'll probably go over it with a fine tooth comb the second time however.
Just a note. The Ford service part number (E4ZZ-9A589-E) is obsolete, but you can still get it as a Motorcraft part (#CM-4349) through any Ford dealer and most auto parts stores.
