The problem I have is a kid that is seven and weight under 50lbs can gain enough momentum to cause in injury of this measure.

The problem the old fart (Yes, it was intended) is going to have is to prove that it was the kids fault. I would love to see the jury on this one when the guy takes the stand and states that he was severely hurt by his negligence. Also if you “tore a shoulder tendon” why have you not had arthroscopic surgery yet as a tendon connect muscle to bone. Also how does an injury preclude him from his job at readers digest? Heck, I guess I should be writing excuses for all of my athletes that have has shoulder surgery this year. They cannot do any work.

To me it smells like a cow pasture. This is what insurance is for and if you do not have it that is the gamble you are taking.

But if the person who causes injury to you has insurance, that is why they have it - that is the gamble they are taking when they let their kid loose on the slopes.

Nobody here has ever sued anybody? And am I the only one here who feels that someone injured by another party deserves to be compensated?

No, your'e not the only one.But 75k sounds a little bit much.
Take care of his legitimate medical,forget the comp for wifey,and move on.

I agree. It should be compensation for a financial loss, not a windfall.

All this sueing is B.S. I could of sued my eye doctor for screwing up my right eye for life. I detached my rena(or however you spell it) and he told me this surgry will make me see again and did for a year then i detached it again. He didnt include the fact that i was young and scare tissue grows back very easily on a 14 year old boy. well does the same exact surgry again and it only stay together for 2 weeks. Then he said he was going to give another shot but it was only 50/50 that it was going to work. well needless to say it didnt work. Those eye surgries were very pain, lay you out for 1 week in bed then another month from reading and lifting more than 10 pounds. So now he sends me to speacialist, who can do a better job than he can. Well the speacialist fixed me up without a problem.

Why didnt my first doctor send me to this guy after he failed the first time? Im still wondering that myself. I'm pretty sure i could of sued the doctor doing for what he did to me. So far my mom(single mother of 3 plus going to college) had spent 30,000 on my eye surgries that failed due to the doctors stupidy. Due to this stupid doctor i lost 2 years of my high school life to him plus, im only going to get back like 70%-80% at the most of my vision back, also to add to that i now have a lazy eye.

Why didnt i sue the doctor well i think its wrong to do. I still wish we wouldnt of had to pay for all those surgries that didnt work but we still did. I'm jsut gald i got part of my site back in my eye.

Well i guess where i getting to is that its wrong sue people for some of the dumbest thing. what makes it even worst are the judges that let these cases into court. Mcdonalds makes their coffee to hot and it didnt say it on the cup and i spilled it on myself when i was pulling out of the drive through so lets sue them. Why would a judge even let something like that into court in the first place. If i were MickyDs i would sue that person for being so damn retarded. They should make it a law that you cant sue people for stupid ***** like this. I mean ***** happens.

Sorry about talking to much about this just had to get if off my chest

Should we not sue, no if it merits that type of reaction. What I am saying is that we are only getting one side of the story. Who says that the man was not stopped in the middle of the slope and the kid was in the right. $75,000 is a lot for a shoulder injury as it normally calls for about $30,000 for the operation and $10,000 (at the most) for rehab. He also went to the suit first and not to the insurance company or his clam was denied due to lack of evidence. IMHO it just does not smell right.
