If you still have read/write access to the files you want then there's no reason to go there.
I would suggest copying the files you want over to another media.
i am looking on "my computer" page right now, do i just right click local disk c, then past it on the external hard drive e?
You need to select the directory then copy and paste to the new drive..see below
What I usually do is copy the my documents directory, because most of the stuff to save is under there. There are some that are not needed and that depends on what programs you have. Just try the whole directory..
Next copy the following directories under c:\documents and settings\your name
Favorites---these are your internet favorites. if you don't need them then skip it.
Desktop --- Some people save files to their desktop so don't miss this.
Application data -- this has program specific data that you may need.
Under the c:\documents and settings\your name\local settings
Copy the application data directory -- this has your email and address book plus other program specific data.
If you copy these you should get mostly everything, But try searching for JPG and Doc files to see if there are other directories that have stuff you want to save..

i can find most everything else, the the old "my documents" i can't seem to locate, i see the new one just fine with nothing on it, but the old one is what i really need out of everything. any suggestions for finding it?

It could be under default, owner or your name.
If that doesn't work just search for documents and see what it finds..
To search for docs
go to start
Search
For files and folders
All files and folders
For the name type in *.doc
This will search for all documents

after that, its impossible to recover files? even with a recovery prgram as someone mentioned?

First of all. . . good luck getting your laptop up and running.
Here is a vendor that I have used several times for harddrives, batteries, etc.

Now, they have a unit that plugs into the USB port and houses a laptop harddrive.
(Best Buy had Western Digital hdds cheaper than these folks, last week.)
Anyway, here is the external housing:

I have one of these. There is a CD in the package that the laptop will boot to. Then you can either 'ghost' the laptop's internal hdd, or 'archive' and compress the laptop's hdd.
Bottom line.
I was going to suggest one of these units, along with another hdd.
Ghost the original hdd onto the external. (Unplug the external hdd unit afterward!!!)
Then, with your original disks, low-level format the internal hdd and re-install the OS, or 'restore to original configuration' with the manufacturer's CD.
Then, it is a simple matter of hooking up the external unit with the 'ghosted' data, and copy your needed files back onto the laptop's internal hdd.
(Did that make sense???)
Anyway, if we were closer, I'd let you use mine.
