clutch
Is there any sure way to know if the clutch is new or not? I press the clutch to the floor but sometimes still have trouble getting it into second. Could it be a worn clutch or bad tranny?

It could be any part of the clutch system. Master cylinder, slave cylinder, the line itself, the pedal linkage, etc. It's most likely not the clutch.

start simple, when was the last time the tranny fluid was changed and what trans are we talking about?

check hydraulic clutch master cylinder fluid as well.
