as many of you know this guy works inside a dealership in new jersey as a shop forman/ asst. service manager.
in n.j. and n.y. the title most state lemon or buy back. and is recorded in the states data bank. i have seen many cases where the buy back/lemon was sent to p.a. and retitled . pa drops the lemon buyback/lemon off the title which gives some one a chance to try and slip a bad one past some one. i have also seen one case where a car was purchased and when trying to title it in ny. the dmv clerk advised the person it had a ny lemon recorded on it. purchased in pa.
the only way to find out is by doing a factory search of the vin or a state by state search of the vin.
what i'm trying to say is there are ways around the laws, and one has to be very carefull and be willing to spend a small amount up front to properly research the vin. ie carfax and paying for a factory form if nessary.
my bother a chevy nut was looking at a very loaded gmc donally when i asked my gm rep. to look up the vin. he found a ny lemon title and the truck had a clean pa. title. please be carefull gang . waste some cash before you buy in research
just got off the phone with the owner and manager all they keep saying is let us fix it. I kept telling them to get me out of this truck and they don't like that idea. Can someone please tell me where i can get a copy of this disclosure law
try going to your local bbb office and while there file a complant
if na has a lemon law. look in your phone book for the lemon law office under state offices and call them for copies and explain what happened. see if they can help.

Lot of good advice already been stated but one of the best ones (IMO) is to pay a small fee (maybe even get a freebie) and get a legal consultation.
If all else fails:
Get yourself a big humongous 2-sided sign that reads something like: "this dealer sold me a buyback vechicle w/out disclosure" , put that in the back of your truck and park outside of their doorstep and/or drive around their street, preferably on a busy day like a Saturday.
I own an 03 buyback. You get a 12/12 lemon buyback warranty from the day it was delivered to you, in ADDITION you still get your 3/36 as well as the 100k engine. Take it back for a full evaluation with all of your complaints, document what has been done and what needs to be done BEFORE either of your warranties expire...remember, the 3/36 still covers you after the buyback warranty expires....hope this helps!
Let us know what the Sales Contract sales/stipulates
First step, now, is to read your sales contract. Is there any mention that the truck was sold under any "conditions". You are going to have to sit down and read it.
And as mentioned to you, keep a log, particularly of the phone calls/discussions.
Names, dates, and times.
Read the sales contract, and let us know of your findings.
the owner just keeps telling me to bring it back so they can try to fix it again. I've been told by many people to talk to a attorney before I bring it back. I also found this website, please read it all. www.ftc.gov/bcp/lemon/ford.htm
Later, to put more "teeth" into the process Ford amended this form to state that the dealer's purchase of the buyback vehicle constituted its agreement to indemnify Ford from any cost or liability arising from the dealer's failure to disclose the status of the buyback. (See center of Disclosure Form, included as Attachment 4. Instructions accompanying the Disclosure Form are included as Attachment 5.)
Ford pays its Ford and Lincoln-Mercury dealers $400 to administer a buyback from a customer. In 1994, Ford began paying dealers an additional $300 just for living up to their obligation to make disclosure. Although Ford is not involved in the retail sale transaction between a dealer and retail purchaser, Ford believed higher compliance could be achieved by dealers if dealers were paid an added bonus for fulfilling their obligation to disclose to purchasers. We pay this bonus to all of our dealers, even though some states still do not require disclosure. (See Attachment 6 for a letter to a particular dealer spelling out its eligibility for bonus payments for disclosing the status of the buybacks it sells to its customers.)
Along with Ford's announcement to dealers that they would receive a bonus for making proper disclosure of buybacks, Ford informed them in an all-dealer letter that penalties, such as loss of auction privileges, would be imposed for failure to make disclosure
I found that part to be very interesting.
Is it a Ford dealer you bought this truck from? If so. I would go directly to Ford Corporate. See what happens there. In fact, I would anyway. They may be very interested in non-disclosure incident.
I bought my 04 PSD X as a 'buy back' and was made fully aware of it by the dealer before I even stepped foot in it. They provided me with OASIS reports and any other information I requested. There was also an official Ford sticker on the drivers side door jam that tells you if it is an RAV and that there is warranty on the vehicle. I am in Georgia and I know it is the law here that whether it is a lemon or a RAV, the dealer is obligated to tell the consumer verbally and in writting. When I closed the deal I had to sign papers pertaining to the RAV and that I was aware.
I did run a VIN on Carfax and saw where FOMOCO in Detroit had purchased the vehicle after the first person bought it.
Got a super deal on the vehicle knowing what the problems were ahead of time. If I had seen leak problems or head gasket issues on the OASIS it may have scared me away though. Mine had a surging issue that has now been taken care of with a new engine wiring harness.
Flybyu, you need to state if you bought the vehicle from a Ford dealer or some used car lot. Also, what does you paperwork say? Did you sign a disclosure agreement? Is there a white sticker on the drivers side door jam stating that it is a RAV?
RAV vehicles are fine as long as you know what you are buying! I love mine and know what the history is. I can't imagine finding out about all of this after I purchased it though! That would be hard to swallow.
A lot of these RAV's go to auction houses, so who knows who buys them for resale
If you bought if from a Ford dealer I would be putting some supreame pressure on the owner and contacting Ford. You will have more leverage from a Ford dealer than Joe's Auto Sales.
