Roadside search question

Ok let us analyze some Jay-Z lyrics (which I know best from DJ Danger Mouse's mixup of Jay-Z's Black Album and the Beatles White Album):

"License and registration and step out of the car, are you carryin' a weapon on you i know a lot of you are?"
I ain't steppin out of **** all my papers legit
"Well, do you mind if i look round the car a little bit?"
Well my glove compartment is locked so is the trunk in the back and I know my rights so you gonna need a warrant for that.
----

Could someone actually get away with that? NOT stepping out of the car when ordered to, just because their license and registration are legit? NOT allowing search and pointing out that the glove box and trunk are locked? Does having the glove box locked make a difference? Of course the trunks on most American vehicles can't be left unlocked anyway.

I've got nothing against (most) cops and I've got nothing to hide, but I'm just interested in what a citizen's rights are. I guess it probably varies by state.

I know that around here, if something in your vehicle is locked (EX: Toolbox, Trunk, Car-top carrier, ect...) then the cops need a warrant to search it (unless they have a drug dog and he finds something)

An officer only needs "probable cause" to be able to search your car. For example (in an extreme case) the officer thinks he sees Zig Zag papers or other "drug paraphanelia" and now he has probable cause to search your car and you.

Someone correct me if I'm wrong but that's how I've heard it, at least in this state. BTW, of the few times I've been puled over I have ALWAYS been asked to step out of the car, unless it was the right shoulder of a freeway. My guess is they do it to get a better feel for what state of mind you are in...

I've never been asked to step out, but I've only been stopped 3 or 4 times in 15 years.

I have been asked for permisson to search my truck a few years ago. I had a gun on the seat in view. I declined to give permisson to search my truck. The cop decieded to call all of his buddies in the area to try and bully their way into my truck. I stood my ground and after an hour of wasting my time they moved along.

I think they can only detain you for so long before charging you with something. You can ask them "Am I free to go or am I under arrest?"

The trouble with exercising these rights is the cops don't like the hassle, they like citizens who will just roll over for them.

This kinda reminds me of cameras in public places and people complaining about "privacy".

Got nothing to hide? Why not let the cop look around to his heart's content?

While it's your right to refuse, that might be enough for "probable cause" if you're nervous or just plain nasty about it... Catch-22

I always comply no matter what... Never had a problem with a cop. But then, I'm a white-guy with no obvious over-inflated ego, no loud mufflers, no huge "bling bling", no guns in the car, etc.

Yup, so am I but I will NEVER forget those jerk cops in Moraga, CA who pulled me over one night, illegally searched my car and planted mace and marijuana in my trunk when I was 19. Leaves an impression on you for life. Because of those 2 cops I would never allow a cop to search my car without an attorney present, cause I've already been a victim.

Geeze, when I read the title of this at first I thought you were talking about IED searches. I've been in the sand too long.


Anyways, I have nothing to hide. I usualy carry weapons and I tell the officer outright as I hand him my license and inssurance. I've never been asked if they could search my truck, but I've been told that if they do you can request to have their supervisor present before they cunduct the search. An officers job is hard enough, I try not to give them any more problems when I get stoped. I have a LOAD of respect for those guys. While I only go to war a year at a time, they go to war almost every day.

98+% of the police are good guys, it is the Mark Furmans who lie under oath and plant evidence that you have to avoid.

You don't get to choose who pulls you over.

And the more citizens roll over and submit to government/law enforcement, the more intrusive government will become. It's a vicious circle.

Just like your local government, if you let their spending go unchecked, they'll just keep wanting more.

In Iowa the police are able to conduct "random" searches at any time, for any or NO reason whatsoever. You can literally be pulled over just because the officer wants to check your driver's liscense or registration. That is why driving drunk at night in Cedar Rapids is a bad idea. If it's after 2am, and you are alone in your car and a cop sees you, chances are you will be pulled over for something.

If you are asked for permission to do a search, you've just been told that there isn't probable cause. Not sure about getting out of the vehicle, pretty sure you have to do that, though there may be some restrictions(wait for a supervisor and such) some places.

There are so many crazy laws out there, it's possible to have something illegal and not even know it.

That's disturbing to read. That sounds more like a subject than a citizen. The short answer is that the Supreme Court some time ago affirmed that a law enforcement officials instincts alone constitute probable cause. The officer merely has to say "nothing in particular it just felt like something was wrong."

To me, that is way too intrusive.
