I know of someone that is possibly planning to vandalize my car. I know that he plans to jack the car up, and steal the wheels. What could I legally do if I catch him in the act? I live in Texas, and I know that if a burglar comes into your house, you can legally shoot him. I have no intention whatsoever of shooting this person...I'm just wondering what I could legally do to him if I caught him in the act.
Sure would be nice to make a video of what he was doing to the car then call the cops and show it to them . Bonus points if you got his license plate in the video and him walking from your vehicle to his .
I dont have a garage. I was thinking of coming outside when he's doing it, waving an unloaded gun, just to scare him. If I saw him out there, I would assume that he is trying to steal my car. Would me resorting to physical violence to protect my property be illegal? Thats my main question. I want to know what I can and cant do without facing possible legal action.
If anyone waves an unloaded gun around they are a fool, what would happen if he decided to defend himself and he had a loaded firearm? Now as far as what to do...I would either wait in the shadows nice and comfy in a lawn chair, enjoying the stars until he comes then share some of those stars with him (baseball bat to the back of the knees will make sure he dont get up to quick) then dial 911 and let them do their job. The video is a good idea if you want to take legal action just dont tape yourself beating the tar out of him..

I've seen on the news here in Texas about people shooting Repo men and getting away with it. If your gonna try and scare him with a gun, it better be loaded just in case he has one too. Texas law sez that you can protect yourself and your property any way you can.

Check and see which security company your bank uses for their video systems or which the hospitals use. Also start looking at the window stickers in local stores. This will help you weed out the truck slammers that don't really have a clus as to what they are doing.

I'd say go with the camera. If the threat is for real.. catch the guy legally. Hand him and the video over to the cops. He'll be in a heck of alot more trouble than he'll imagine. You'll catch him red handed..
I'm thinking about it especially since I am getting some additional damage and the keying fixed.
I'd be tempted to catch him in the act and taser gun him and perform a citizens arrest until the cops arrive to cart him away. If you can get his actions on video that's even better. I say taser since it's non lethal and quiet.
I like the video cameral idea, as the consequences can be much longer lasting, but whupping him up sure can make you feel good! If you Do go the physical route, wait until he has actually removed one of your wheels, or at least some of the lug nuts, so you have some evidence he was the perpetrator. If you can wait until he has a wheel in his vehicle, you can probably get the best of both - whup up time and then call the police to come get him!
If you know he is after the wheels, spend a couple bux and buy a set of wheel locking nuts. It would at least slow him down enough that you could grab your camera.
Some kiids in HS used to mess with me and my buddys trucks..... one of our parents sat there for a couple hrs with a video camera. We comnfronted the kids who promptly told us there was no way we HAD him on video... I said ok... and a few days later he was chatting with the police...
