Need Advice
I have a 2004 f-250 cc 4x4 6.0. I have had the truck in the shop 12 times in the last 12 months. All the normal stuff, binding when turning, exhaust leaks in cab, numerous oil leaks, rear main seal, both head gaskets, and now bad klunking when turning. I am really starting to not trust the truck,Since this is the first 31,000 miles. Talked to dealer todoy about ggeting ford to help me out with a new truck as I feel that I have a lemon. For about 2000 down and 30.00 more a month They will put me in a new one. I don't know if a buyback is in order but if anybody that has been through this I'll take any advice I can get.
Thanks in advance
Man, from the looks of it you have some pretty stiff lemon laws in your state! The question is this, has your truck been in 4 times for the same thing? If not, has it been in for a total of 30 days (out of service) for multiple things (remember weekends count)? If the answer is yes to either of these then you have some footing IMO with Ford.
Your law also says:
It shall be the duty of a dealer to notify the manufacturer of the existence of a nonconformity, defect, or condition within 7 days when the motor vehicle is delivered to the same dealer for a fourth time for repair of the same nonconformity or when the vehicle is out of service by reason of repair of one or more nonconformities, defects, or conditions for a cumulative total of 20 days. The notification shall be sent by certified mail and a copy of the notification shall be sent to the Motor Vehicle Administration; however, failure of the dealer to give the required notice required under this subsection shall not affect the consumer's right under this subtitle.
None of this guarentees that Ford will play fair and do the right thing it just means that you have options should the rep choose not to. The big thing is have all of your documentation ready, be polite but firm and document EVERYTHING that is said by you AND them, you may need it later.
The last thing is read the lemon law fully! There are provisions in there from what I have quickly read that allow for some form of choice by you that gives you some bargining room.
Good luck!!!
You might want to purchase a micro recorder and be there when the field mech looks at your truck. Your state shows that the law requires you to inform them if you are recording them http://www.rcfp.org/taping/quick.html but I would still try since people tend to forget exactly what is said and I can almost guarentee what you are told face to face will NOT be what is written.
Good luck!
