Cops speeding

Does anyone know if a Cop in a marked car can speed without his lights or sirens on??? Cause one came up behind me speeding and got me for speeding, and I want to fight it.

Legally, they are just another car on the road unless they have their lights AND siren on. However, they speed all the time. They go x mph over the limit, anybody they can't catch at that speed gets pulled over.

Hollywood, if he got you speeding while pacing you should have asked for his ticket book so you could write him up as well. I would mention that in court as well.

Here's your problem- by showing he was speeding, you'd pretty much have to admit that you were too. The judge is only going to be interested in one of you- the one that got the ticket. Was this in the US or up north?

Years ago (probably 20) a marked car passed a friend and I,we were doing the speed limit, think it was 50 then on that road.He had no lights/siren on,so we followed him (at 70).We got a ticket,(2 longhairs in a Nova)he claimed he was going to a "silent" call, which gave him the right to speed. We went to court and the judge asked for record of the so called call he was responding to.When he failed to provide the info. we walked out and he got a "reaming".Without the em. lights and noise makers "they must follow the same rules as any citizen on the road",according to that judge.

Quite often they do on a call that is not an emergency. Otherwise, they have/should (to) abide by the posted limits. Obviously your cop wasn't on a call if he stopped you.

A cop here in NY can break all traffic laws they want, with or without sirens/lights. At least, that's what I read 10 years ago in the traffic law book, or something like that.

Think about it - he was speeding to CATCH UP TO YOU ! You don't have a snowball's chance in heck.

Around here, on Long Island, Suffolk County PD officers don't speed unless they are pursuing someone. Lots of times you see a few cars flying on the roads, they are going somewhere in stealth so as not to spook whoever they are after.

And, especially on highways, they sneak up on you so you don't try to flee.

I don't think you have a chance if you were speeding. He came up on you so fast because he was pulling you over. Around here, they don't put on lights and sirens as soon as they "clock" you... they only do it when they are right behind you to pull you over. The fact that he scared the heck out of you before putting on the lights/siren, well, change your underwear...

Man, I hear this all the time on the scanner, some nitwit will call in on a cell ph. and complain that a tractor trailer pulled out in front of them or someone is driving too aggressivley, the sherriff or troopers will do whatever to investigate the complaint, cell phones are great, but some people need to just lay off. nuff said

Yeah, because DWI is not a "traffic law" violation anymore It's a misdemeanor... or maybe a felony now...

Back when it was a traffic violation, I'm certain they got away with it all the time ...

In most jurisdictions the police are allowed to violate the traffic laws to catch up to or stop a traffic violator. Some are required to use red lights and sirens and others are not. If an officer is caught DWI, they usually suffer stiffer consequences than the regular Joe. Take the same expenses of lawyer and court and add to it losing your job, losing certification, etc. Its not to often you hear about someone from Sprint being stopped for DWI in their personal car and losing their job over it.
