Glad to hear this idiocy is over for you. Unfortunately I know your pain. Brother was driving a Ford Ranger and was center punched by a full size school bus doing 35mph and this broad claimed she was hurt and permanently disabled, blah, blah, blah. She sued him for $500K - Unfortunately, his insurance company decided to settle with this idiot for $30K. She and her attorney should have been charged with insurance fraud. Guess it was cheaper for his insurance copmany than going to trial but the matter drug on for three years before it was over. Peeed me off. Like in your instance, it was somebody with no money looking for a lottery ticket.

I am glad that they don't have speed limits here.
55mph is only like 90kmh, even where we have speed limits for large vehicles, it is only on trucks above 30000lbs, and it is 62mph

They were grasping at any straw they could find. One point they tried to make was that by me going 70 MPH with the trailer I was speeding by 15 MPH whereas their guy going 83 MPH was only speeding by 13 MPH, therefore I was the worse speeder and it should be my fault.
They tried all sorts of things, most of which were not relevant or full of flawed logic.
Not sure if I missed it in the thread? But who paid your attorney costs?
Your insurance company usually takes care of the lawyer for you. The biggest cost when you are the victim of this type of crap is the emotional toll it takes on you and your family while you wait for it to play itself out. Tort reform anybody????

Good to have you back Daryl. I was in CA last year, and actually worked in the Folsom,CA hospital if you can believe it, for eight hours. I'm glad no one tried to tangle with my Super Duty. My insurance co.might have given me a hard time about it, being that I was out there for six months. What happened to no fault accidents out there? I thought that was the way it was done. Even if the other guy totals your rig, your insurance co.gets stuck with the bill, and you have to go civil court or something like that. They ever heard of the Good Samaritan law in the Republic of CA? Anyway, welcome back.
Daryl, I would like to thank you for your perseverance! Every one who works to eliminate frivolous suits deserves a pat on the back.
That being said, what is up with California and everyone suing each other??
To be fair, it's a big problem everywhere and not just CA. The example I gave earlier occured in VA. Sleaze ball attorney's and low life plaintiffs are the cause of this problem and there is no good way to hold them accountable at the moment. This why there has been a big push for tort reform the past few years.
Daryl, glad to hear that everything turned out for the best and that the truth came out. Sorry you had to go through what you did. Glad that the jury came through for you!
