according to my emmissions testing manual, there is currently no actual "gasseous emmissions" testing in the USA for diesels, however there are "particulate emmissions" testing states that test using a light beam projector across the exhaust exit, much like the tester for window tint.
the removal of the GUTS of the cat wont affect either of these tests. but the states that do a "visual emmissions" test, like some counties in PA, will fail and fine you for complete removal. although diesels are exempt from the visual here in mercer county, some places they are not.

That is correct for Colorado. Although I'm not sure if that includes a visual test of the system. If it does, and the tech sees there is no cat you could fail.
I say buy a cat test pipe that bolts in it is only 3 bolts. I put my cat back in every time I take it in for warrantee work. takes me 15 minutes, which includes getting out my 15 mm ratcheting wrench and digging the cat out of the garage. I have a cat test pipe that I removed off of a 2000 PSD it bolts wright in stock 6.0 exaust. hope this helps. Jerry.

for those who havent figured out the secret, the 6.0 exhaust is the same as the 7.3 exhaust, minus one little ding in the DP. the 7.3 will go on the 6.0 and 6.0 will go on the 7.3 if u add the "ding" in it
If you choose to slip in a section of 3.5 pipe where the cat used to be, try coating the ends of the inserted pipe with anti seize. This lets you slide it out much more easily if you have to reinstall the cat for warranty work. A cheap strap wrench or two will help. I use the 4-inch wide double bolt stainless band clamps- that way you don't "crimp" your aftermarket pipe with the standard muffler u-clamp, and it comes out and goes back in much more easily. Utah inspects for Particulate in some counties, and if they see it has been removed, they will fail it.
Since I have a welder and alot of tools I usually get to install alot of the exaust for our our local truck club. I usually keep their old exaust. The 2000 that I removed the exaust from came from the factory without a cat so I jest used that portion of the pipe and bolted it into my 2004. Big Hoss is right a 7.3 will bolt up to a 2003 and 2004 except for the turbo down pipe, So if you are trading in your 7.3 make sure you at least swith out the cat back.
