What does the service manager at the dealership you bought it from have to say? Have they considered a replacement? I would talk with the service manager and the general manager. List the history of the truck. Be friendly but firm with them. Tell them what you want done. What is the configuration of your truck? What is the build date and engine build date?
.....another first post with problems.....I say the problem has more to do with the dealership rather than the product. So anywho....Welcome Eddie....

I did ask them to buy it back at this time they told me they would for 10,000.00 differance.
...was trying to get more wholesale money
IMO the sales manager is busting you hard on this. He ain't trying to help. If you are looking for a Ford by back you need to be very specific in your discussions. DSB / Lemon Law should be mentioned in your next dialog...not wholesale to a tote-a-note dealer.
Hopefully you have everything documented. In addition, your OASIS report should be enough to get the Ford Reps moving on this if what you have described has been noted there.
Good luck.

but I know of what I speak on Texas lemon laws
(having done two with previous manufacturers )
basically they state -
if within the first year or 12K miles:
you can't get it repaired properly...when
3 times out of service for repair of the same non safety related major item,
1 time out of service for repair of a safety related item,
or more than 30 days out of service for ANY reason...
(including dealer incompetence
)you are eligible for lemon law relief...
Now, save ALL documentation,
make notes of all conversations, who, what, when, etc...
get reciepts for any upgrades, maintenance, etc...
and go up the chain with a firm but calm approach...
and questions like these:
"what woudl YOU do if this were your truck?"
"Would you put your family on a cross country drive in this truck?"
etc... etc...
Know exactly what you want to happen and be prepared to negotiate a settlement when the right person comes along...
I did not do dsb or lemon law on either case...
I just went up the ladder until someone in authority could give me what I wanted...
start in svc dept, then gm, the owner of delaership...
then get Ford area rep involved... have a lwayers name ready as "leverage"...
not for threats at this point, but just as a "Mr XXXX did tell me that blah, blah "
good luck and have fun with it -
only way to make a bad situation better...
you are in the drivers seat...

If you are going to try to get a buy back or a replacement, you need to go to the service manager and the general manager. I wouldn't deal with the sales guys on this. The sales type just want a new sale. Go to the service manager and get him on your side.
If things don't work out, I know where Nyles Maxwell lives.

I know you aren't going to want to hear this, but don't give up on your truck. I have a Jan 13, 2003. Not a single problem. The problem is the incompetence of dealers. In all honesty look at the name of the service tech on your invoice, as to see his crudentials, you have legal grounds for this. If he is not diesel certified, you have just about guaranteed grounds for winning a board for lose of earnings and out of service reimbursement due to dealer negligence. I personally know a guy who had found out he had a gasser tech working on his truck, they had it for a 21 days and couldn't find anything with it, so he found out about the gasser tech, he started the process of a reimbursement suit, in one week the dealer wrote him a check for 21 days of lost pay, and one month of a truck payment due to their negligence. He never even had a board date set, they knew they screwed up. The other cool part, he took it to my dealer afterwards, in 4 days they had it fixed. He has since put thousands of miles on it, without a single prob. He says it runs better now than new. He is now getting 16.5mpg calculated. There really is hope, just ask on here who is the best dealer in your area. Then go there, and I bet in just a few days you will problem free.
Best of Luck,
Corey
