Just to let ya'll know, i won my DSB today. It was a unimous decisoin that i had a lemon and that ford needed to replace it or give me my money back. When they went out to look at my truck it had a small puddle of oil where it had leaked in the parking lot . So i proceed to show how the undercarige was covered in oil from the truck, and they saw the how the truck was leaking all over, they all agreed. I would say to anyone that goes throught this is to make sure you DOCUMENTeverything. I showed about 5 thing that differed from ford / the dealerships. Just had to let someone know, cause i am smiling from ear to ear right now, that i am not stuck with this lemon anymore.
Congrats !!!
now let the negotiations begin about what you'll do....
remember when they ask you what you want - ask them back
"If this were your truck what would YOU expect?"
and then double it and start again :-)
I had what I consider to be great succes when they replaced my 02 with the 03 and will be glad to help in any way !
Yep, congrats on winning your case. Feels good, that's for sure. I sent my acceptance letter in yesterday and I still haven't figured out what I'm going to do. I still have a week or two.
Sorry it has taken me a day or 2 to post but i lost my hard drive on my pc... ...
I am not for sure what i am going to do yet. I want another PSD but if i can get more bang for my buck and get my money back and then get an 05' PSD i may do that. What do you guys think?
Apparently there is no change to the 05 Excursion so it doesn't pay for me to wait. But the SD's are suppose to get some nice updates so I'd wait to get one of those. The only problem is you may loose money by taking your money back, sitting on it and then getting the 05. The hitch comes in if you had a trade in on your buyback truck. Since you only paid sales tax on the difference between the trade and the price you paid for the truck, you only get that tax refunded. If you turn around in 4 months to buy a new truck, you pay the sales tax on the entire truck. Depending on your trade in, that could be a big chunk of change! You also usually have a mileage deduction to consider if you do the money back thing.
I guess that will depend on exactly how your DSB finding is spelled out and probably laws in your state but the above is true of my DSB results here in MN.

What JEB said is right about the tax and the mileage thing. Ford just replaced my '03 with a '04 last week and I took delivery of it last Friday 6/18. I only had to pay the tax on the difference in sticker price on my '03 and the new '04 which came to $69.75 verses almost $1500.00 if I would have had them buy the '03 back and then I went & purchaced a new truck. Also they were charging me $1179.38 for the 17k miles on my '03 but since I took a trade deal for a '04 they knocked off $1000.00 and I only had to pay $179.38. No one can tell you what to do, but it is something to think about.
