howdy fellas....i'm looking for a bit of advice/help for a guy i work with. he wants to get his CDL to drive here in washington....but a few years back, while in the military he got a DUI in california while ripping around on a quad. when he went to apply for his CDL he was told that cali had suspended his driving privileges and that he couldn't get one. i asked why cali suspended it...and he said it's because he never took a class cali requires an offender to take....he was scheduled to attend it, but shipped out on a boat and missed it.
basically, my question is this.....is there any statute of limitations or something along that line for this kind of offense? he could go and take the class and settle all the other jazz, also go on high insurance...but man...him and his wife just bought a house and had a baby. there's no way they could afford it.
he's a stand up guy, real good worker that just made a stupid mistake. anybody have some advice/help?
Have him talk to the (or another) judge or lawyer. All states have different laws, unfortionatly, you probably wont find much help here. If he wants to inquire about that limitation, than have him go to the local law school and look at the state law books. They can be kinda confusing, but I'm sure somebody in the library can help him.
yeh....that's what i told him. go and speak with a lawyer. he's not too keen on the idea for some reason. i dunno.
i just posted here in hopes that maybe maybe someone else had been in a similar situation, or knew someone that had been in a similar situation, and would be able to offer some input. thx again y'all.
Patuca, if he was on orders to ship out and the class was at a later date he could have gone to his local legal assistance office and had an attorney draft a request to postpone the class. That is what he should have done in the first place. If he is not in the military anymore than he will have to hire a private attorney and then deal with the state of california.
