Well this is the story I m laying in bed it's abou 11.00 pm tuesdaynight when my sister calls . I live in town my sister lives out in the country apparently, the nieghbor is in her yard trying to run over the yard dog. So i jump up and haul out the door in shorts and flipflops haul *** out of town. When i do get there she is in a screamfit where they make the usual threats of violance, I mean she and my mother live by themselves well they continue over several acres, this contiuines until the middle nieghbor yells she is had enough and the law is on the way . Well it gets quiet for about 10 minutes all there lights go out well i give up standing in the cold go to my truck when the blast several rounds of dove load i mean pellts rattle my hood crack my window and hit me. At this point Im beyond mad so i reach behind the seat and pull my 30/30 and shhot the better part of the box in there general direction. Then i head back to town. The dog is well a wheel chasing county dog but i'am out of line when they come in the yard or repeatly try to run him over This uselly happens evry six months but never guns only cusing and yelling. Heres the question what you do in the situation?
I wouldn't say it was a felony. I would say it was self-defense. As long as he could prove he had a legitimate reason to being on that property & they shot at him first, then it is all means Self-Defense.
Well, since this has been going on for a while, and looks like it is going to continue, I'd think the appropriate thing to do is let the local Sheriff's Dept, Rangers or whatever ya have there, know about what is going on.
First off, the neighbors are in the wrong coming onto your mom's property, for any reason, without permission. And coming there to drive their vehicle across the property to try to do the dog in has to be in the illegal files somewhere.
Question - what is your mom's dog doing to get the neighbor riled? If it's running free, feel lucky they don't shoot it if it goes onto their property. If it's not running free, then its chained up or confined to the yard ...right? Owners of pets have the responsibility of containing and controlling their critters.
That said .. the use of guns by either of you to settle a dog dispute is totally irrational. One or both of you is going to land in jail ... or the hospital. ( or worse ) I think you need to refer back to my first comment ... contact the local law and have them talk with the neighbor and your mom to find out what exactly the issue is and then deal with it appropriately. Letting tempers flare up is only going to cause more trouble than it is worth.

They shot first, you have every right to defend yourself. HOWEVER, you should have NEVER fired in a "general" direction. That makes you guilty of reckless endangerment at a minimum. You also should have waited to the sheriff arrived. You could have showed them the proof that you where fired on. Then they could have taken them for attempted murder. I don't know because I was not there, but your story sounds a bit "full of holes"
If the dog was on your property and they tresspassed onto yours trying to run the dog down I'd think you'd have a good case against them. Especially if you can video tape it.
If someone came onto my land and tried to run down my dog I would probably shoot them. You have a right to defend your property to some extent. Never been to sure how far it goes. But trying to kill your dog, well thems fighting words.
If your moms dog is getting someone that ****ed try to fix it. If someone came and did that to any part of my family I'd kick some butt. Fightin words yes, shootin no. I love my guns way to much to have someone take them away, and this aint worth killing over. Don't point your rifle or pull the rigger unless you plan on following threw cause that might be what it takes to get the nutcase nextdoor to try and kill you.
Next time hes on your moms land just kick his ***.
I checked once with the animal control cause a neighborhood dog was in our yard for a week straight when my dog was in heat. Don't even know who owns it.
The animal control said if I shoot the dog on my acreage, that I could be liable to a lawsuit by the dogs owner.
Yet animal contol tried once to catch it and it ran and then came back.
My advice to you is to sacrifice the dog to the cause- then sue them silly.
No offense, but that was a pretty stupid thing to do... I would have taken the gun into the house, and waited for the sheriffs to arrive.
That way you have no gun on you, and proof they shot at you.

No personal "grudge" just I wouldnt recommend doing it again.
Well i called Sheriff's They come out and said since the dog running in loose in brazos county free we are wrong, but since they came on to the property there wrong and we should all play nice. The Dog itself never goes further than the property he just runs the ditch. The Problem goes back to when my father 20 years ago was a Sheriff's depuity even then they would just get loud untill he put one of thems cousin or brother in jail and it started. Plus when someone has been drinking since 3 in the sfternoon it's kind of hard to talk reason.
