So I listed my 89 Aerostar on a local website for sale. I listed it for $1300 OBO emissions tested but not saftied. Some guy emailed me and said he wanted to buy it but he wanted it saftied. Not really a problem because I had the vehicle saftied about 6 months earlier. He said he would give me an extra $50 for the safety. SO I said ok. That put the price up to $1350. He gave me $350 as a deposit and I wrote him a receipt saying he paid $350 and $1000 was due once the van was saftied. Well, I took it in to get saftied and it needs $500 worth of work. Well, I don't want to deal with this! Because next thing you know it will cost me like $600-700! You know how mechanics are. So, I called the guy up and I told him the situation. He gets all defensive and says that the deal was the van was to be saftied and everything. Well, I told him I didn't think that it would cost that much. So I am only gonna get like $800 when this is all done and over with. Unless, the mechanic charges me more, which he will do! I have got a couple quotes and they have both been the same pretty much. I offered to sell it not saftied to him and he could deal with it but he doesn't want to. I also offered to give him his deposit back and not worry about it but he really wants the van. Any suggestions? All this money is in Canadian dollars! LOL!
The guy wanted it safety inspected, and you had that done. He didn't say he wanted it to pass! Give him his money back. There is no implied contract guarantee in your taking a deposit from him. I would offer him the van less the safety inspection fee (the $50). If the fellow wants the van, then let him fix it and get it safety inspected.
