You are certainly open to civil suit action if you tow over manufacturer limits. Buy hey, not my truck/trailer. Do what makes you happy.
A civil suit can be brought against you for any reason at any time. Your dog pooped on my lawn, I could take you to civil court for "damages". Why your dog pooped on my lawn, or what your were feeding it at the time is totally irrelevant, I'd be suing you for the damages you caused.
Towing over the manufacturers suggested limit (and it is just that, a suggestion, nothing more), is not breaking any law. A civil case would be suing for damages caused, why or how you caused those damages is totally irrelevant. The only thing relevant in civil court is that you caused damages/ loss/ made someone feel bad because you offended their made up grievance group identity/ whatever to some other person by your actions and as such owe them restitution.
If it was against any law, then the whole Hot Shot /LTL trucking industry simply wouldn't, and couldn't, exist as it is now. And those companies/ drivers have plenty of lawyers looking to sue them for anything they can (mostly because they know all commercial drivers have commercial insurance).

A Toyota Hilux will tow a 10K camper. A few feet at least. The point isn't what is physically able to tow what, it's liability. What happens when you are in an accident (that might not even be your fault) and the other driver's insurance wants to go after you for being overloaded? You might be completely safe and confident towing over limit but that's not the issue. Stay with the truck. I have not done research on SUVs in the past 7 years (since I got my Excursion), but didn't Chevy still make solid rear axle 3/4 ton suburbans into the mid 20-teens? I know they dropped the big block, but payload might be better.
The Suburban 3/4 ton is rated for 9000 pounds. **** Poor!! The Expedition EL is rated for more than that. Yes, your over payload...
I find ironic how the guys who have their 3/4 and 1 tons pick on being iver weight. I see MANY 16k+ campers being pulled with SRW 3/4 and 1 tons, talk aboit being over pin weight!
