Power window complaints

I was flipping thru the channels last night and came upon some people suing over power windows killing their child. Yes it is a great loss but come on! What were the kids doing in the car, with the key on (all the power windows I've seen don't work without it)! Where's the parent??? They think it's the auto makers fault!
They want all power windows to have automatic retract if something is in it's road. Yeah, that would be a good idea...but what if you want it to close on something.. maybe an intruder's arm?? Guess some people don't think.

Exactly what happened? And any chance it was in California?

Can you elaborate a little more on the circumstances of the accident? I hate to comment not knowing all the facts.

Sorry the rest of the message got cut off!
The one mother on tv was saying her daughter was leaning out the car window trying to pet a dog when her knee hit the window button. Thus sending the window up, catching her neck lifting her up choking her to death.
They showed tape of windows cutting tomatoes, carrots, other various veggies saying that the window uses 80lbs of force to lift a 30 lbs window. They belive the window should only use 30lbs of force to do such, the excess power is what killed her child. Many auto companies responded they do have safety features built in, such as the lock out button on the drivers door. Tthe parents say it is not enuf. Their should be lift levers rather than push buttons for window controls or the auto reverse windo function. From what was stated foreign cars come equipt with the auto retract function. The parents are pushing for all US made cars to adopt the option.
I guess what gets me going is the parents don't like being called "bad parents" by the auto makers even though they were the ones who left their children unattended. And rather than live with thier mistake blame it on others, sue, and raise the cost of new cars for all of us to pay.

Lemme see one SERIOUS reason for having excessive force, being able to shut the window if soemone is trying to reach in.

Personally, Where was the parental supervision? Why did the 'resposible, or so she claims' mother not use the lockout so they could not be used from the back?

Irresponsible people charging a corporation for damages that were their own fault...

Lots of kids play, some get hurt, others bruised, a few maimed and killed. It's called LIFE!

Ultimately, they would have to sue the hospital where the child was born for bringing it into this world so that it could be killed by it's own parents stupidity...

Some people are living proof that Darwinism has far too many loopholes.

Exactly. Or just turn off the ignition. Kids get hurt, that's just a part of life. Trying to limit their exposure to harm, that's called parental responsibility.

"cutting tomatoes, carrrots and other veggies". After reading that I attempted to make a salad with my Ranger windows and made a huge mess.

I know of no modern automobile (except for some older Broncos and grand Wagoneers) where any electric window can operate without the key being in the ignition and with it in the acc. or run/on position.

So, the parent left a child alone in a car with a key in the ignition, in a on position, and left the child that way for at least three minutes. The child could have started the car and driven it away or someone could have stolen the car and child. Sounds like a parent malfunction.

I think on the surface of it, having release handles on the inside of trunks is a good idea. Though I think it opened the way for these kind of claims too.

Most of the Fords out there, the power window will still work with the key in the off position. ONLY if a door has NOT been opened. My last three models work this way. The Detroit free press had a good article about this on tuesday. If they make them automatically open if something is in it's path, then there would be lawsuits because so and so got raped or murdered because they opened automatically . I'm not sure if it was Ford or Gm that said : If a child got injured in this way then the parents were not watching and protecting them, so we should be liable?
That is the question any jury or judge should ask, "Where were you as the parent when this happened"
Anything to try and get a buck. The lawsuits these days are getting out of hand. Somehow it should be corraled.

I think the woman should have charges pressed against her, it's illegal for anyone to leave anyone under 15 in the car with the keys in it.

It's simply not possible, feasible, or economical to make everything on this earth "childsafe". Children are unpredictable, you have to watch them like a hawk!!
