commercial regulations?

Hey, does anyone know if dually cc lb trucks are supposed to follow commercial laws in ohio. my truck has a gvw of 11500. i have it plated as farm at 26000 lbs.

Any vehicle having a GVWR of 10,001 lbs or greater is subject to the FMCSR (which most if not all states have adopted) Everyone confuses FMCSR compliance w/CDL laws, again FMCSR at 10,001 lbs or greater, CDL is 26,000lbs or greater, unless the towed unit is in excess of 10,000 lbs or greater. Confused yet? hope not! Some states exempt Farm vehicles, not sure about Ohio. I would check w/your local Farm bureau for that.

Or call you local state police office and ask about commerical weight requirements; and what trucks are exempt. Here in Arkansas we have "Highway Patrol" which is different than the State Troopers...HP is Arkansas' DOT (truck cop) and know pretty much everything about DOT compliance. They're definition of commercial truck is one used for inter & intra-state commerce. A pick-up pulling a horse/cow trailer isn't considered commercial here in Ark; again...you need to call you local state police office.

I agree with SP or HP, problem being is im not sure how Ohio is situated and if you can even get through to some state DMV offices you'll get two different answers to the same question. If you can speak to the "real world" Trooper out on the road in Ohio you'll will be better served than some office staff. Many Farm Bureaus have quick access to this info and will often send the info to you as well, they are a great resource.

Ohio I'm willing to bet is probably going to be the harshest of states when it comes to regulations for towing vehicles.

I used to go to horse shows up in Ohio, but they always tried to nail me on traffic violations(of which I would win, they just didn't expect me to come up and dispute them, the cop never showed in any of the cases). They are perhaps the "worst" state when it comes to this. Now, I've never towed out in Cali, so they might win out I don't know, but Ohio is for sure a place I no longer deal with.

Keep in mind that there is usually a distance limitation on how far you can travel from your farm as an exempt vehicle (usually 100 - 150 air miles).

Follows are a couple of well written documents which apply to KY and IN which will give you some good information. Maybe you can find something similar for Ohio. Do a Google search and I'm sure you will find these documents available in PDF. If you don't find them send me your E-mail address in a PM and I'll send them to you. I've done lots of research on this subject and it's not easy to get a handle on exactly what needs to be done. Even if you talk to the DOT you are likely to get different interpretations of the law depending on who you talk with.
