If you remove the spacer the linkage might not clear the intake. And yes, it will affect emissions and performance. NOx emissions will increase due to the higher combustion temperatures and pinging will increase without adjustments to the timing and fuel curves.
Can it be done? In a word, yes. Would I recommend it? No. Others might though. It would depend on how you were going to use it.

I have had 2 different customers that when we did a valve job they eliminated the egr valve and they stuck, and bent a valve. The egr valve helps bring the combustion temp down, when temps get high the valves seem to "swell" alittle and get "lazy" in the guide movment. Then the piston comes and gives thema little tag!!
