I was awarded a Patent a few years ago. When you apply, you have to do a "Patent Search" to demonstrate that you researched to see if anyone already had a listing for your idea.
You wouldn't believe some of the stuff that is listed. Google has a free Patent Search. It can be a riot but sometimes you come across some real clever stuff.
