Its origins in English law, the Castle Doctrine states that if a criminal breaks into your occupied home, vehicle or place of business, you may use any force against the suspect that is needed – and does not require the victim to retreat before resorting to force.
Before the Castle Doctrine was passed, Texas citizens were required to attempt to flee before using force.
Darn good law, and am glad it has passed. I know that if I myself was put into a situation where my vehicle or life is in harm i wouldnt think twice of using deadly force. Been in the situation before and hope it doesnt happen again but will be ready if it does.
This law is perfect for home owners in the City.. Unlike us Country Folk.. I forgot the law but have been subjected to it on several cases.. But in Texas if you own land of any Size and you produce, house, care for Cattle of any nature. Any one who steps within your property line under Trespassing Laws is subjected to authorization for use of Force. It ties into the Attempt to Smuggle, Harm, Destroy Cattle..
We had some kids break into our ranch when I was in high school.. We own 3000 acres in Northeast Texas.. They came through our back fence line about 5 miles from the house.. I happen to be out riding checking fences and so fourth.. Came up to a break and it wasn't a cattle break.. Straight line clipping.. So I went scouting.. Found some kids running around by my cattle.. Not sure if they were heading for the Pond back there or looking for Shroom to get plastered on.. I always rode with my 30-6 and my 9mm.. Took out my 30-6, fired 2 rounds next to them.. Never seen the kids run so fast in my life..
Few hours later Sheriff dept showed up, said the parents pressed charges for attempted murder with deadly weapon.. I gave a statement, informed them the kids cut our fence line, and were running crazy around my cattle.. Sheriff said "Ok, thanks.. Any of your cattle harmed? Do you wish to file charges?".. Told them they were ok and I'd appreciate the kids to stay out of our land
Not a damn thing happened.. Gotta love Texas Cattle laws!
