Any roofers here?

My new roof is leaking around the chimney flashing, the roofer is saying it is not his problem, call a mason. Seems to me flashing is part of the roof. I paid to have a watertight surface over my house right? Thats why I got a new roof. This was a complete tearoff including plywood, the contract does not mention flashing however but it doesnt mention nails, underlayment etc which were obviously included either. When I initially met him I even pointed out the leak and cited it as a major reason I wanted a new roof (along with aging shingles).

Any advice?

It is his problem, the chimney should have been re-flashed and if he failed to do it or do it properly then he is liable. Don't let him weasel out of it.

The roof should include all flashing, especially if you told him about it in the beginning.

Get that guy back, flashing is a part of the job. If the is a masonary problem with the chimney (and it would have to be real bad) you should have been notified in advance of the roof work. Might even have to go as far as small claims court judging from the roofer's attitude. Good Luck
