Buyback Mileage? Settlement?
I have been speaking to Ford @ buyback program. Rep said we have had too many problems, the truck does not display Fords standard of Quality and the we just got a bad truck. She said she was going to pursue the buyback option. this morning she says, we are sorry but we can not offer you a bb at this time. But we will give you a months payment back for your troubles..........WHAT? no expalnations, no nothing.
We had previously determined that our vehicle fell within in the standards of the TN Lemon Law, and that I was within the time guidelines. The area manager called today and offered to reimburse us our ESP warrenty cost and waive the $100 deduct. for our LOCAL servcie dept. only, but because we have 50,000 miles on the truck, a buyback would be too diffiicult. (our first issues were at 11745, and we filed at 34000!!!).
My question is for anyone who has experienced this. What do we do? If we take the $$, do we forfit our LEMON LAW option? If we push a little harder will Ford give a little more? Are our current miles too high? PLEASE ADVISE.

IMO, it will very important for you to speak with an attorney since the truck was bought used...could throw a few extra wrinkles into the mess.
Interpretation of the TN Lemon laws will be critical.

Have you contacted lemon law attorney yet? Are you just doing this on your own? If so call an attorney who deals with lemon laws. I am currently going through same process with my 05 F350 cc psd. I contacted a lemon law lawyer first. He advised me to go through the planned arbitration and except nothing less than a buy back or a new truck. If this did not happen I am not bound by arbitrator's ruling. Call him back and I will go from there.
