how do you sue?

how do you sue?

I have a dispute that I want to try to settle in court. Anyone know how to do this? Do I use a civil court? I don't need a lawyer, so how much will I be expected to pay?

depends how much money you are talking? small claims court?
you would need to file with the court clerk then pay to have the other party served by a constable.

I dont know about where you live, but here you can see a lawyer for free for one hour. Might be an idea to check into also.

It's a small claim, maybe $4000.

I think small claims are limited to 2500 around my neck of the woods. Above that you have to go to regular court and suing someone there without a lawyer is very unwise unless you truly believe he/she will not even show and you expect a default judgement. If he/she shows up with a lawyer, you will be, as they say, "bringing a knife to a gunfight".

I would like to know details of claim,, Dont think much of suing unless all avenues have been exhausted!

i know several people who have had small claims cases including myself and i and one other did recieve letters from Judge Joe Brown, showing an interest in our cases, how they got the info i have no idea?

Call up your county court house and ask for the court clerks office. They will have the info on court costs, procedures, filing and serving. Pretty simple really. If you don't like my advice, sue me.

I filed in small claims court last year. Location Missisippi. Cost was around $50 to file and $25.00 to serve the defendant. I won my $1900 and garnished her paycheck. I received my money from her employer about 11 months later.

I think we'll be OK as long as there is no specifics discussed, ie, no names, rants, etc - just the general mechanics of how to file a small claim to get the ball rolling. Much like, "How the driving test is different in your State," type of thread. Myself, I don't really care to know more than that. It's good practice to never write or say anything anywhere that could be used against you.

Most small claims courts don't allow either side to have attorneys present. There's nothing that says you can't retain one for consultation beforehand, but generally they can't be there for the actual court date. Remember, nobody has a specific right to council in civil matters. Its just a provision that keeps the process as simple and as inexpensive as possible for both parties involved.

Limits depend on the state. I think in Georgia the limit is fairly high, $10,000 if I recall correctly. Some states may also automatically award the plantiff any costs associated with the suit should they win the case. Otherwise you'll need to make sure to include them in the amount of damages yourself.
