When I moved into the house and half acre I began to buy five or ten years back, it was a peaceful little place that had a quonset hut up the dirt road from us, and a general store with a gas pump.

A farmer nearby had the brilliant idea to split quite a few acres up into lots, develop them, and sell them off like hotcakes....

The people who moved into them THINK they are going to have a "Home Owners Socialist Republic"....

But I have news for 'em, I WAS THERE FIRST!!!

I have left standing instructions to the family that if any Homeowners Association communist SOB approaches them, the answer is not only HELL NO, but HELL (F-Word)ing NO....

If your beamer is allergic to my mud truck, give it a regular bath in flea dip. It ain't my problem, sonny....


Get it straight; we moved here to be FREE of egg-suckers like Y'all. And we gonna have an occasional "Thow-Down" if we please, with catfish from the river, and loud music, dancin', and cars & trucks parked just all OVER creation. Smokers and Bar-B-Que's going all weekend long, and a whole lotta coleman coolers full of not only soda but also (OH YES! That bane of creation...) BEER! -All kinds of beer...

And if I think of something I want to do to anything I drive -

Hey boy! It's MY driveway.

If you don't like it, don't let the gate gitcha in the britches...

Because we care about what we can do, and don't spend all of our time tryin' to STOP folks from doing what they should be free to do if they so choose.

Well put Wolf, I heard ya loud and clear. I'm sure as heck not gonna stop my parties, my friends and family and their friends and families from having a good time, mud races and the like. It's like you're danged if ya do, danged if ya don't. If ya do, ya take crap from all those yuppie beamer drivin uptight blowholes, and if ya don't, well, let's just say you got yourself a boring pathetic life, and you're just like those yuppies, workin 9-5, coming home, eating, and going to bed. No sir, not for me.

These homeowner's association rules are called CC&R's. (Covenants, Codes, and Restrictions).

Last year we bought a home that was built 40 years ago. It's in a nice neighborhood in the country. All custom built homes on large lots. It wasn't built by a developer, you bought your lot and hired your own contractor. No two homes are the same.

I was surprised to learn during the real estate transaction that there were CC&R's attached.

Here they are:

1. I cannot operate a dance hall on my property.
2. I cannot sell liquor from my home.
3. I cannot breed goats for market.

Our neighborhood has horses and some cattle. The "homeowners association" was on paper and does not exist today. But if I ever decide to turn my house into a dance hall, sell liquor and barbequed goat...I'm in a heap'a trouble if my neighbors bring legal action on me. Because I agreed to the CC&R's.

1) Dance around an open air fire pit. It's cheaper to build, and makes the neighbors even MORE nervous.

2) Export the booze, that way you don't have to wherehouse the hooch.

3) Why keep GTO's (GOATS), when you can have a yard full of "BRONCO's"????

People here buying new homes are interested in keeping up thier property values and neighborhoods.Houses here are built mostly in developments and to buy one of these houses you must sign a contract with the devolopment association in order to buy the house. The contract basicly gives the association a standing lien against your property and that is where they have you.If you do not maintain your property they can send in a contractor to do it and send you the bill. If you do not pay they can forclose take thier monies owed and the court will give you the remaining monies from the property or the court can tell you to pay up and go home.If the association is wrong or overboard in thier demands you can get a lawyer to stop them .I was very unsure when I bought one of these houses I did not know much about associations but have had no problems and my neighbors are very patient about my old trucks 2 of them, and it is a nice neat neighborhood. It depends on what you need and want and the customs of where you are.

It's bad enough having city codes, let alone adding a homeowners association on top of that. I wanted a privacy fence about 6 feet tall and my city won't allow greater than 5 feet tall on a privace fence. Seems to me that most folks can see over a 5-foot fence, so where do they get off calling it a privacy fence? My sister was in a trailer park that required the lawns to be sprayed to prevent weeds! What! I try to promote weeds in my lawn. I don't want a chemically dependent grass monoculture. My kids like to cultivate the weeds and we let anything but poison ivy grow in our lawn. Weeds at least stay greener in the dry season. And no way do I water--what a waste of money and good water. If it can't grow there by the grace of God, then I am not going to help it. Exceptions are starting new transplants and vegetable gardening

"Homeowners associations," like zoning or land use ordinances, require that you first do a little research BEFORE you buy (or rent) a house, property, whatever. There is no such thing as a "home owners association" whereby someone (or some entity such as a town or private group) can "take" your property or restrict what you may do on it....unless YOU signed a piece of paper (otherwise known as a deed) that has some restrictions (known as covenants) included as part of the land/ property sale. When you sign that paper and it happens to say "No junk vehicles," it seems to me that you are on your own. Your decision.
The same reasoning applies if you buy land in a town that has zoning and than you discover, later, of course, that some things (restricting land uses ranging from junkyards to house color) are "not allowed." Should a done yer homework.
If you live in a town that never had zoning and now, because of an influx of newcomer Buffies-and-Jodies (yuppies-for lack of a better word) that want to live in "the country" (but upon moving into their new "cul-de-sac country house," complete with a 3-car garage, and than call the police when a racoon sets off their motion-detector floods)....well then...it sucks, because their vote at town meeting counts as much as yours (remember: the private property rights thing).
Thats why I moved. I now live in Maine, where property rights is a huge issue, as it is in most rural parts of this country. Before I bought our lake front land, I did some research and determined that there is NO ZONING here. So, while I can continue to have a few dead Fords scattered around the woods wired with sound for blasting the Grateful Dead all night long and howling at the moon, I must also realize that my future next-door-neighbor may want to establish an all-night pig farm shoot-a-rama. And there ain't much I can do about it except bitch...or wish I did my homework.

[updated:LAST EDITED ON 13-Nov-01 AT 10:49 PM (EST)]One other thing to remember about homeowners associations, some towns are now requiring that the developer of a new subdivision form an association and maintain it for X number of years as a condition of allowing him to move forward with the development. Goes back to the "do your homework before you buy" theme.

okay I have read every posting everyone did and when I moved into my house there wasn't any such thing as an association this is just a bunch of people that decided amongest themselves that they were going to take control of the nieghborhood and call themselves an assosciation well needless to say my attorney has contacted them and if they even post another piece of paper on my house or contact me thru the mail or by telephone they will be looking at charges againest them for 1) an illegal assosciation 2) threatening and intimidating along with good old harassment

iam sorry guys/gals but i have to laugh at this. in the city with the homeowners blue tarp laws parking laws ect. i live on a res. that seems to have a home owners association. no space on the lawn shall be clean you must have at least. 4-5 junk cars and 2 piles of scrap metal if you dont youll be fined for being wastefull. lol i really dont understand why people put up with homeowners i agree with you all . its your house do what you want.

ps. dont get me wrong about the res iam and indian Iam not being predjudice.
