Anyone Experience This?
You could be looking at a time frame of up to 6 months before it is heard in court.
You may incure lawyer and filing charges that you would not with the DSB.
If you go lemon law you will most likely have to submit to the same independant inspection process.
It seems unlikely that you would lose on a safety related issue like brakes. The liability for ford alone would be staggering if they fought and won and then you knocked a school bus or something off a cliff when you had a brake failure. I would also think that an inspector would want to cover his backside and not give the truck a clean bill of health.
Normally the DSB and lemon law only require 2 shop visits for safety related items. Not everything that you would think is a saftey related item actually is, but brakes is right there at the top of the list.
Bottom line: Let the inspector and the DSB do their thing. If things are not ruled in your favor then you still have the option of going forward with the lemon law suit. The DSB rulings are binding on the dealer and Ford, but you may seek further action if you choose.
Good luck, keep all your records.
