No way...not unless you do some cutting.
This is 39.5 on a 10.5 Edge which actually measures a little over 11" in lift.
38s will rub under an 8" lift off roading....depending on which brand of lift and which brand of tire as well as wheel selection you may even experience rubbing on the inner fender turning into a driveway or parking lot.
A 40/13.50R17 MT/R is the "smallest" 40" tire I'm aware of, but you'd need over 8" of lift to run them.....also springs that shift the center pin forward would help.
I have pics of a 8.5" lift with 38" PJs on 16.5x9.75 wheels in my gallery......I might be able to fit 40" MT/Rs with some trimming or shimming of the bumper for the street, some trimming of the fender to clear them off roading. For a wider 40" on a 12" wide wheel I'd need to do cut-out fender flares and trim a bit off the bumper to clear them. Keep in mind I run a 4.5" hanger and shackle with a 4" spring so my springs won't deflect as much rearward as a 8" spring would.
