some of my friends this weekend decided to get drunk while hunting.
the guys land they were was gone and it was jsut his wife there and the wife called my 3 friends in becuz they were "disturbing" her.
the sheirffs came and when they got there, everyone one of the boys ran to avoid the minor but they all got cot
al 3 of them were charged with a minor and fleeing a cop
alot, but i think if they were given permission by the husband, and the wife just didnt know it or didnt inform them that they were no longer welcome , the judge might let them off with a warning, or the prosecuting attorney may offer a pretty good plea bargain, since no harm was meant by any of it.
but that is just my opinion, not my interpretation of the law.
It's always best to sit still and own up to what one has done. Evading an officer is a crime in itself. Your friends could have said that the owner had given them permission and that could have been confirmed at a later date. It's always best when hunting on private property, to have written permission with you.
The drinking thing... one shouldn't be drinking and carrying a gun. I know... a lot of people do it, drink and drive, drink and drive while out in the boonies hunting... but it isn't safe, it isn't ethical and it isn't legal. It also doesn't help the opinion of the "anti-hunting" groups when we are caught doing something like that. Fuel for their fire.
The amount of trouble depends on how they were written up.
Did the deputy note in his report that they were drunk? Thats got a real big chance of making it nasty. Few prosecutors and judges are gonna lighten up on three drunk guys hunting on land that isnt theirs.
I would venture to say that was a stupid thing to do.
Had the land owner given them permission?
Had the land owner given them permission to hunt drunk?
Are they 21 or older?
Had they driven there, and planning on driving to leave?
Is it illegal to hunt while intoxicated?
Is it illegal to brandish a weapon while drunk?
Oh yea....running and evading.........

I hate to say it but I hope they get the book thrown at them because its illegal to do all the things they did and then ya wonder why all your favorite hunting spots are closed Just what I want out in the woods when Iam hunting a Drunlk with a weapon !!!!IMO of cours e
