Let me start by saying how much I hate are fat goverment & the insurance companies that control them like puppets!
I was on a country road posted 50 miles an hour. I was following a unmarked state patrol (2002/3 off white suburban). I had be following him for about a mile when his lights come on...he pulls over and lets me by...then pulls me over. Gives me a ticket for 60 in a 50. He said he paced me! Does this seem right?
Yes, they can pace you - they have "certified" spedometers. Their spedometers are designed and calibrated to be accurate. One thing you might be able to get them on is to find out how often (if ever) the spedometers have to be calibrated and when it was done the last time. I know that the radar guns have to be calibrated daily or weekly around here. I know a few people who have gotten out of a ticket on the radar gun calibration issue when they can't present the paperwork.
I guess it's pretty sneaky of him to pull over like that in an unmarked car and then nail you - you probably had no idea it was a police vehicle until it was too late. If I'm ever behind a marked car I make it a point to let him put distance between he and I. A 2002/3 unmarked suburban is darn near impossible to tell from behind (unless several antennas might be a giveaway).
I always look at the rear plate of a vahicle. In most cases is will say exempt or something like that.
I would argue that the officer baited you by running 60 and creating a dust cloud on the dirt road and you couln't see the speedometer because of the dust in your eyes.
I suppose I should stop following cops that are speeding, ha. Anyways that's really lame, seriously. I'm sure the rodes are much safer now, because odviously he can drive 60 without any problem, but you might just kill someone.

We actually have one here in Iowa that has a totally unmarked car even has mag type wheels on it, tinted windows (which is illegal in this state), and cover plates that look like regular state plates, and actually are but not the real plate for the car. I have seen him drive down the interstate at 80+mph until someone starts following along, then after a couple of miles he will pull off like he is taking an exit, then after the car passes he pulls back out, and pulls them over, I actually have witnessed him doing this twice in the last 3 months. Personally I don't think unmarked cars should be allowed in traffic stops this creates a bad precedent, as in the last 10 yrs 2 women that I have heard of were pulled over by a fake police car just an ex patrol car with lights in the windshield, then they were raped, and killed, but we are supposed to pull over for an unmarked patrol car so how do you tell the difference.
I've gotten off twice by using this method. I first pay the bail amount which is usually in the range of about 300 bux (at least in calie it is). I then plead not guilty, and request to have a hearing. I then postpone the court date once I receive the notice in the mail, I usually go to the court house, and say I can't be there due to financial hardships, my boss only gives me tuesdays or something like that. I then get a new court date (by this time it's been about 4-5 months since the ticket was issued). If I feel the cop is going to show up I postpone again. Usually by the third date, it's been 6-7 months and the cop doesn't even remember that he ticketed you and doesn't show up... wala off your record you get your 300 dollars back ... consider it a savings plan
A speed pace is usually done from the rear, as a retired CHP officer I can say I did a few thousand of them. I have never done a pace from the front and written a ticket. I have allowed people to pass me then pace them. I believe in CA a pace from the front is rulled as entrapment. You might want to check that out in your state. As for hoping the officer won't show up in court it's a roll of the dice. I always went to court when I received a subpoena but sometimes the officer can't make it or just forgets.
gunther I believe you are right in most places plus as you know it is almost impossible to judge distances in the mirror close enough for a true pace plus driving down a gravel road I would be suprised if the officer in question could even see the other vehicle half of the time, my guess would be that he thought he was bieng followed, and decided to issue a ticket as an excuse to find out who it was, or he was heading somewhere he wasn't supposed to be, and didn't want someone following him. probably should have just pulled you over, and warned you about speeding, and sent you on your way, I would fight it even if it costs a lawyer fee, it is cheaper to pay the ticket but when you add up all the costs it is cheaper in the long run, and probably is entrapement, and that type of action by officers needs to be stopped as this is the type of things that cause hard feelings towards police officers

Is that the one that runs around Prairie City sometimes? Like on 163 or whatever on the southeast side of Des Moines? I think I've seen him pulling somebody over once. Exactly...all they're doing is baiting you. And they're just as likely to have an accident. It's crap. Same with "pacing" you. Unless they're on their way to an emergency, or actually catching up with somebody, they should have to obey the traffic laws as well.
Ever seen a cop turn on his sirens, go through a red light, and then turn them off. If i were you, o would request to see proof of the speedo being correct from the manufacturer, and then ask for a document of the last time it was calibrated. Then jerk them around for a while, check out the entrapment laws, etc.
Alright the thing to do if you get pulled over by radar is immediatley say. I WANT TO SEE THE RADAR! Keep saying that and just push and push to see the radar. 90% of the time they fabricate your speed or exgatterate it. Be careful though, if you make him mad enough even if youve done nothing wrong he can/will arrest you for whatever he wants too. They by law can arrest anyone for no reason at all, say for instance your bumper sticker says "bad cop no doughnut" if the cop is mad about that he can pull you over and immediatly arrest you. This is not a joke it happens all the time.
FIGHT IT!!! He was setting the pace. You were just following traffic.
Don't be too quick to use this argument. I went to traffic court to fight a parking ticket once and saw lots of guys fighting speeding tickets. One guy used this argument, and the judge asked him "would you have been impeding traffic had YOU slowed down?" The answer was no, and the guy had to pay the ticket plus court fees.
