I sold a truck to a Hispanic and he's trying to get it into Mexico. The Vin # on the title does not match the Vin # on the truck. I went to the dmv and they told me it never has and that there has been a big mess up. It's been this way for 14 years and no one caught it until now. The state has told me that the only way they can fix it is if the truck is here in Illinois but it is in Texas. The state says the dealership must have made a typo when the sent the info in when Brad bought it new.
Its not my fault the guy took it to Texas and did not check the Vin # first right? I did not know nor did the guy I bought it from and he bought it brand new. I have a feeling they are going to want money to get it back here I but don't think its my fault so I will not give them any.
Sounds like a string of errors... You bought it and did not check the VIN and title. The buyer did not check the VIN and title. About all he can do is bring the vehicle back to you and demand a proper title or his money back.
I should think that if you reported it as sold to your DMV, it is no longer your problem. there is nothing you can do if you are no longer in possession of the vehicle. You didn't do anything illegal, so i think the person with the "problem" is the buyer here. Let him work it out if you can.
if the buyer didnt catch it when he bought it and you didnt know about it (werent trying to deceive him) then you did nothing wrong in my opinion hell even the dmv didnt realize it
i say do what you can to help the guy but dont spend any of your money on it though
Thanks guys...so far the guy is being cool about it. Were trying get a bill of sale notarized and see if Texas will take it and fix it in Texas. I am going to get a lawyer or is this a bad idea
I don't think a bill of sale is going to help. A bill of sale is usually only usefeul for a non-titled vehicle. Signing the back of the title when you sell it is, effectively, the bill of sale for a titled vehicle. I feel for the guy, but it really was his responsibility to check the VIN when he bought the truck.
ok ok here ya go, now selling a vehicle without a title is not a crime, selling a vehicle with a title that does not match the vehicle for a profit could be considered one. The thing is that how was your plates registered?? to the VIN on the truck or the title...basically a typo was made but was it on the title from the factory or a mistake on a 2nd issue title you should be ok but i would contact an attorney if you think stuff is gonna get hairy.. my .02
You probably don't need a lawyer yet, it doesn't sound like the buyer has made any demands. Don't make any promises (verbal or written), and you can't really get into any trouble that your lawyer couldn't get you out of later. No need break into the barrister budget if the buyer isn't even going to mess with you.
