First Fender Bender!!!

First Fender Bender!!!

Alright guys this kinda sucks but I thought I would share the bad news with ya.

I was at a friends house the other day and I was backing out of her driveway. Well this telephone company is doing work across the road I guess, like putting a new line in and their F-350 dualie happened to be parked right in the road where I was backing out. I looked both ways but wasn't expecting a truck to be in the road parked so I idled out and crunched his bumper. The guy actually did not own the truck (it was his bosses) so he had to make the police report and go through that. I got a small dent in the back right side of my bumper and I hit is backside. Luckily his truck was lower to the ground than mine since my trim level is XLT and I don't know what his was but his bumper was bent upright a little because I clipped the top of his. My bumper also (supposedly) hit is paint a little too, which I don't know if it really did because it was a work truck and was pretty demolished in the first place.

Do you guys think that would be my fault or his??? Or both?? I would appreciate anyone's input!!

And do you think my insurance will raise?? I have had my license since 10/10/2003 and that was my first ding.

I wouldthink both If a utility company is parked in the middle of the street they should have cones or something. Did the police assign blame when doing the report?

Exactly that is what I was thinking! No he Just took the insurance companies and measured and all that stuff and took off... Does the insurance company "place the blame"? or who will do that?? and will i have a chance to have my say??

my guess is that your insurance will go up if you are even 1% at fault you insurance goes up the same as if you are 100% at fault atleast thats how it works with my company (Farmers)

if no tickets are issued, you will both be at fault. The claim alone will increase your premium, even if it wasn't your fault. You are considered at fault as he wasn't moving, so you should have been aware of his presence, and if he was stopped on the travelled portion of the roadway, he would be at fault. Typically, if you are moving at all, you are partially at fault. If you are stopped, and someone hits you, they are 100% at fault. Even though he was parked on the road, you needed to be looking. I wouldn't expect it, but I alwqays look for it, because, as you found, if you don't expect or check for it, it will bite you in the behind. Always expect the worst, and you'll never be surprised when it happens, defensive driving attitude.

Up here in the Great Green North,the person who was backing up, has to pay the most care and if they cause an collision,they are at fault especially if the other vehicle was parked.

When I was a kid I lived in snow country. There was a law in that area that no on-street parking was allowed during the winter months so that the plows could get through, I lived on a cul-de-sac and pulled in the driveway in my Dad's '69 Mercury Marauder, and about 1/2 hour later came out again and started to back out. The back window had iced up in that time so I couldn't see, but I figured it would clear up when I got the car warmed back up so I didn't bother to scrape it, it was iced on the inside. I just backed out by Braille and hit an AMC Hornet that had parked on the street while I was in the house. He lived a couple blocks away and was visiting my neighbor, but instead of parking in front of my neighbor's house, or in his driveway which would have been the only legal place to park anyway, he parked across the street in front of an unoccupied house, right where we always backed out. Pushed the driver's door in pretty good. Well, I got a ticket for unsafe backing, and the Hornet owner looked pretty smug about that, but you should have seen his face when the CHP handed HIM a ticket for parking on the street in winter! And my Dad's insurance did go up a little...no damage to the Merc. -TD

Ya it sucks!
Now consider that if it wasn't the F350 but was a kid instead, you would be screwed big time. Technically, you got lucky!
I took a defensive driving course (dirt cheap) and it completeliy changed the way I drive. If you take one, will you get some kind of discount on your insurance? Maybe, just for your own benefit, take it anyway.

I got too many tickets in a year, and the State Of Iowa required me to take a defensive driving class, haven't had an accident (with any other vehicle) since, have saved myself from many. When you expect everyone to do something stupid, you can see it coming when they do. I have "predicted" countless incidents that would have been major fender benders just by watching and thinking defensively. NEVER assume your path is clear, ALWAYS check and double check.

This reminded me of an incident my wife had with her Ford Expedition. She rear ended someone but at approximately 10 mph at the time of the accident. She thought she would be slapped a ticket and be held liable for the damage of the other driver's car but much to the surprise of the police, they ticked & faulted the other driver for driving an unregistered car! Technically, that car wasn't supposed to be on the road at all and it got in the "way" of the other registered vehicles!

haha man, i wish that would have been my case, "in way of the other registered drivers" thats a good one
