Well, not really over. More like dragged it. I had plans of getting through with the tile job I was doing for my neighbor, and then put my boat in the water before dark. It was on Saturday, and I hadn't had my boat in the water all year. Money had been really tight, since I lost my job a few months ago. Things were finally coming together for me. A new good job, making extra money for the side job, and I just sold my 69 F100 for $7350. After hooking the triple axle trailer with boat up to my 65 F100, I pulled into Wal Mart to buy some essentials for a night on the boat, and for the next day, since they don't sell beer here until after 1:00 on Sunday. There were about a dozen empty parking spots in a row towards the back. Just enough room for truck and 35 feet of trailer. I thought I was being careful, as I manuvered around a Fast and Furious clone Civic that was sticking out past his parking spot. Thought I had it licked, and I was going real slow. All of a sudden, the truck eased to a stop on it's own. I looked in the side mirror, and my heart sunk. I didn't quite clear the Civic with the metal "guide ons", that help guide the boat back on the trailer. A bolt on the guide ons snagged the rear plastic bumper cover of the car, and I pulled the whole rear of the car sideways a couple of feet. I also rubbed the paint of on the 3 foot tall wing, in a spot about the size of a dime. Maybe smaller. After checking out the damage, I thought to myself, "No big deal". I wrote down the tag number, and went into Wally World. I had the tag number paged, and went and bought my supplies. Nobody had answered my page, so I pushed the cart out to the scene of the crime. Two ladies had witnessed the whole thing, and they called the Law. The owner of the car was also out there, along with his wife and son. I first told the guy I was sorry, I spoke with the Deputy, and then I put the supplies in the boat. I had told the guy I would pay for the damage out of my own pocket, but his boss convinced him on the phone to file a report. I was asked for the usual. License, registration for the truck and boat, and insurance for the truck. I couldn't produce anything current except for the license. I had wads of old paperwork, and I was freaking out. I just couldn't find anything current, even though I keep my stuff up to date. I gave the Cop my sob story, and he said, "that's ok". I almost crapped my drawers. Then he asked me if I knew that my boat trailer tag had been expired for 4 years. I told him that I never received the boat trailer title from the previous owner when I bought my boat. He told me that he would just overlook it. I've always been very respectful of the men and women who's job it is to keep the peace, but this guy was the best. He didn't even file the report. He gave us the copies, and left it up to the Civic owner and myself. The damaged was estimated at "$1000 or less". The guy was supposed to call me tonight after work about a written estimate, but so far no call. I know it'll be a lot better then my insurance going up, and I could have received several tickets, but it still kind of sucks. Having to waste money on a ricer.
if it happened in a parking lot(private property) even if the cop had writen you a summons it would not hold up in court.they do not have jursitction for traffic violations on private property
I was just about to say that. Thanks Wlihntr, lol. If it happens on private property (wal mart, mall, grocery store, etc...) then the police can be called all day long and they cant do anything about it.
He can't do anything on private property, but he could have waited outside the entrance of the parking lot for you to pull onto the street and then pulled you over. So I think you lucked out and had a guy who was being decent that night.
Keep a $7 disposable camera in all your vehicles. If you get into a wreck, take photos of all vehicles involved, and the immediate area. Make sure you get pictures of the skid marks on the road, scatter pattern of glass, etc. If the wreck was your fault, it protects you from the other guy inflating the damage. If the wreck was not your fault, it gives you proof of the damage.
i was just going to say the same i had a minvan run a stop sign in aprking lot and hit my plow. no damge to my truck or plow but it crumbled the minvans front quarter pannel. this all happend in a parking lot. the lady in the van called the cops and while we waited she told me how this was all my fault and young kids like me shouldnt be driving big trucks(iam 20yrsold) etc etc. when the cop came he said he could only write down the facts but that if it happend on the road i wouldnt have been at fault since some wittens vouched for me that i had my turn signal on and even tried to stop to avoid her but she litterally ran me down never touching the brakes. long story short she tried to take me to court to pay for her damges. i called the cop and he said he couldnt do anything as a cop but as a private citizen he could be a wittens. the case went to curt cop vouched for me and i ended up getting money for a new snowplow out of the deal since the judge coouldnt fine the lady since it was on public property but wanted to punish her for being so stupid and selfish. hope it all works out for ya. there real are some nice cops out there.
Camera is a good idea. When I had my 2000 Ranger I got rear ended by someone going 40 miles an hour. I was sitting still waiting to turn left needless to say it messed up the truck very bad and myself. Anyway, The cops wrote everything down and ticketed him for the wreck and even arrested him on outstanding warrants well when the inlsurance company called I was being blamed for it. It was a long drawn out process but when it went to court (insurance companies fighting) I had a cop testify for me that was on the scene. H e advised me to always carry a camera and/or get written statements from witnesses. The cop was also a good friend so it was nice having him at the scend so I wouldnt get taken advantage of.
My experiance with police at an accident scene was the exact opposite.
My brother an I where installing a transmission in his truck - dropped off the core and picked up the replacement and where headed to his house. We where both covered with dirt and grime and driving his "old" truck. Old man driving a new Suburban decided to turn left from the right lane. We swerve to avoid him but still clipped him in the side - both vehicles left skid marks in the oncoming lane.
Stupid cop writes my brother a ticket and says we where trying to pass the old man when he turned left. The old guy claimed he wasn't in the right lane (but he wasn't aware there was four lanes of traffic either). His insurance looks at the cop's diagram and the accident pictures and pays for my brother's truck even though he was ticketed at the scene. Didn't learn till later the old guy had Alzhiemers and the cop (KS State Trooper) was fired for stealing among other things he was doing while on duty.
Y'all are lucky that there are nice cops in where you live. Since i live dont live in a town or city, i have county mounties all over the place, but most of them transferred over from Houston. Big city cops without the crime problem to keep them busy love to target teenagers in big trucks and fast cars. Cop pulls me over since he thought i didnt have a front plate on my jeep. He askes for my insurance and i hand him one of the 2 copies i had, but it was the expired one. He didnt even ask me if i had another insurance thing, just writes the ticket and tells me afterwards. I get the other one to hand to him and he starts yelling at me about how i purposly did it and that he ought to take me down to the county jail and that he wasnt going to take the insurance charge off the ticket. Then about 2 weeks ago, I was out past the curfew and a officer asked for a Drivers license to see if i was over 17, which i am. I hand him my temp license since my new DL hadnt arrived. He then asked for photo ID and i handed him my expired DL which has my picitre on it. He tells me to sit down on the curb and calls his partner over to keep an eye on me as he writes a ticket for being in possesion of a fake ID. Writes the ticket, hands it to me and then arrested me. Posted my bail and then called my lawyer. Went to court the next monday to have the charges thrown out. Judge looks at the ticket to see who the arresting officer was and then throws out the charges becuase the officer was under investigation for several other false arrests involving teenagers. I respect most cops except those from Harrasment (harris) county
i read the stories above all i can say if it happens on private property the police have no authority there. if you are on a street that has a name they do. if the police, for what ever reason, write you a ticket for doing something wrong on private porperty, and you pay the ticket or plea bargain it that is your fault for not knowing that no judge in the county would convict you.trust me it happens
Well, the guy whose Civic that I barely hit, called me just now. He told me that it would cost $1900. I told him he was nuts. He proceeded to try and tell me that the wing would cost more to fix then to replace. I said WHAT? A freaking dime sized rub in the paint? He then said that the lengthwise split in the wing was caused by me. I told him Dude, I remember the conversation word for word. The crack was previously there, but it may have opened up a little bit. We had agreed that I was to pay for the bumper cover and repaint, and to touch up the little spot on the wing. He then tried to convince me, that since the crack opened up a little, I should pay for a new wing. I told him, that since he's trying to screww me, I'll just turn it in to my insurance company, and I'll also tell them the scam he trie to pull on me. I told him that their lawyers can take it over from here. He then decided that he could come up with a new written estimate. I think I should call my insurance company anyhow. What do y'all think?
