3rd time in for same type problem

3rd time in for same type problem

Is there a rule/law about how many times something can be fixed under warranty before they have to replace the whole component? We have a 2002 Explorer XLS that will be going in for the third time for a transmission/4x4 system problem. We are only 400 miles away from being out of warranty too!!!
The first time it was slipping out of gear while driving, they thought it was the sensor that tells the tranny what gear to be in. When they went to replace it they found out the shaft that goes into the sensor had been rounded off during manufacturing so it was not engaging the sensor.
3 weeks later we discover, in a snowstorm no less, that we have no 4X4. Apparently the shift motor and module went out. They replace it and said all should be good. And oh by the way some of the sifting problems from the prior issue could have been related to the module going out because of the computer control nature of the thing. Now less than a weeks after getting it home. We go to put it in 4x4 low and it won't, the light just flashes. It does work in high and auto.
So first thing in the morning I get to make a joyous call to the dealer.
Do I have ground to demand the entire transmission and transfer case along with all associated electronic stuff be replaced???

well before jumping down their gun you said 4x4 high and auto both work and 4x4 low just blinks...for 4x4 low you have to put the car in neutral and with your foot on the brake put it in 4x4 low and then it should work.

Thanks, I was following the proper procedure. However, I think maybe I was being to impatient. I went out today and the 4-low light still flashes, but then I heard the thunk of engagement and the light went solid. First is this normal and second how long should this transition take? I guess when I thought it was broke I didn't think I would have to wait 4 to 5 seconds for it to engage.
Anyway, it does work. I am still worried about it being in twice for tranny issues so far though...

Hi kwebb,

In your state (Iowa) the manufacturer has 4 chances (three and then one final one after you notify them in writing) to try and fix a problem that "substantially impairs" the vehicle. Or, if we're talking about a serious safety issue (which it looks like we're not), they will have 2 chances (one and then one more after you give them notice in writing). Here is a link that has the whole Lemon Law Statute for your state. It's a long read, but if you continue to have problems I would say it's definitely worth your time. Also, pay particular attention to the section titled, "Nonconformity of motor vehicles."

my 98 XLT takes a couple - few seconds to engage in 4L. never had any problems, but you do have to stop, go to N, change to 4L, put in drive, and wait for the 'thump'. i've never seen my blink. if i forget to go to neutral or something, then it will just stay in 4H or 2.
