try and find someone to file an appeal this whole thing sounds crazy to me and a gross miscarriage of justice

Have you considered the ACLU or getting some publicity on the radio or TV that paints the judge and DA in a very bad light? There's nothing they hate more than bad press.

In my now erased original ramblings, I meant my legal interpretation of the situation is meaningless. More or less all of us are talking out of our rear-ends on the legal mumbo jumbo.

As for the rightness or wrongness, we are qualified to speak on that. However, your situation is no longer a matter of rightness or wrongness. It is a legal matter that can only really be handled by people trained to deal in such problems. On our qualifications to offer moral support, we are well qualified to give that. That is what I meant to say.

My moral support: I think your cousin is getting railed in the deal. I would push very hard for lawyers/advocates for your cousin. It is going to be an uphill battle though. Nobody wants to take the side of a man convicted of having sex with a minor. It would really make them look bad--really bad, as in, pedophilia-esque bad. Somewhere you will all find the strength to fight this fight to the bitter end. Of that, I have no doubt.

If you can find somewhere his Constitutional rights have been trampled on then perhaps, yes. Maybe "cruel and unusual", due process, etc.? Its worth a shot and costs nothing.

Maybe exposure on a national radio talk show? Call them all, from Stern to Rush to Boortz.... make sure you mention the judge and DA name's each time.

Right a letter to the editor... see what happens.

No, your advice is not meaningless.

There has been a lot of good posts here, and I too, see a terrible injustice, to your cousin, the girl, and both families. But the truth is , thats history, nothing you can do about the girl or your cousins actions. And yes, appeal, appeal, appeal. There must be evidence, character attributes, etc, that is just not getting to the jury, on both sides. The thing you must do, is remember judges are just people, and they all look at the people in front of his or her bench, as misfits , not being able to disipline their own lives. So ,they start each case out , beating down on the defendant, and the only person that can steer that preconcieved action , is a fine lawyer. Now , we all know that not EVERYONE that ends up in front of the bench is a misfit, and that it can be just a end result of a lot of bad circumstances. And, we all know that not ALL lawyers have the same level of expertise, personna, knowledge of the law. All doctors and lawyers DID NOT ALL graduate at the top of their class. So finding the RIGHT one is a major and MOST important issue here. Because as we all know , the judges word, is the last word. And getting his/her WORD to be in your favor , will take the best attorney you can find, that is SUITED for your case. All court cases are controlled by attorneys, get one that a judge doesnt like, know , or doesnt care about what they have to say in your defense, and your case is lost. SO, that said, the best road to take in my opinion /experience is : #1 Find a lawyer that A: has a excellent reputation in matters like your cousins case. B; Try to find a lawyer that KNOWS the judge trying the case, and has a good repore with him/her, and hopefully one that has had a lot of cases tried by that judge. You never know, you may find a lawyer, that the judge just plan ole likes, THEN you will see a big difference. And no need to say this , but good luck, and Godspeed be with you on this one,

Hey, i am from texarkana and i have not read anything on this case. However, there are some very good attorneys here. This is just sad on all counts but get the kid a better lawer>

The judge should be flogged (say, 10,000 lashes with a cat of 9 chains).

He should have killed her...he'd be out in a third the time. Absolutely insane.
