Got some more accident pictures

Here are some more pics of my truck and the car that hit it. She hit us at driving speed, never touched the brake. Witness said she was passed out before hitting us. Also, she had jumped curb a half a block back but got back on the street and kept coming. When I saw her right after the wreck I thought she was dead. But according to my insurance Co. she was snockered and they took her to jail from the hospital. If we hadn't been there she would have driven right in to 6 lanes of crossing traffic. That might have been ugly. And I'm sure that we would have been badly hurt of worse had we been in a car. Seeing her car I'm surprised she walked away. Word of advice, if you want to run into something don't choose a DRW 350. What do you body guys think, is that dent in the cab gonna mean a total? Or will it all depend on the frame?

Really depends on what state your in and how many miles is on the truck. The cab being dented will add alot to the fixing along with the frame, if it is bent. I would say that it is tweaked by the pics. I would say there is probably 14k-18k of damage.

That dent in the cab can be pulled but my guess is they will total the truck. Blue book is still higher than the cost to repair from what I see but in Maryland 75% and they total it.

It's gonna be close based on Photos. Lots of stuff unseen. Gonna depend on insurance company. I'm not sure I'd want it fixed looking at those photos.

Last night I went through the truck and all the after market stuff for replacement cost. Then I added the engine and transmission builds I had done last year (December 23 for the engine) I'm up around 45,000 bucks. I hope I don't have to fight that battle but I don't think I should lose all that because I happened to be sitting where their insured decided to pass out and hit me.

You'll prob have a little bit of a fight, but I'm certain you'll win. Have you consulted an attorney? Had additional Dr Visits? Physical therapy?

Is your axle shifted? It looks like the overload spring is moved forward of the pad.

Yeah, I see what you're saying. Could just be the angle I took the picture from. Trucks at the dealer now, may know more later today. Also, I got the accident report. The woman that hit us was 67 and blew .16 which I think is twice the limit in FL.

i was sayin to you the other day Stanley.. I would really consider acquiring a well known attorney.. it's going to be hard to re-coupe everything.. if you decide to try to keep it they can fight for loss of value...something called diminishing value..i think is what my attorney told me because you dumped a boat load of money into the truck...now your looking at losing it for no fault of your own... I'm kind of with the other guys don't know that your truck would ever be the same...even with extensive repairs... it sucks the big one man!

Any chance it's paid off? Then there isn't a lien and your options open up a little. You could possibly get a check for the repairs and then part out what's left.

That's a plus even though I know you wanna save her. If it were me, I'd pray they total it, squeeze as much $ out as possible, then discuss buying her back at salvage costs.

I'm gonna give them a chance to do the right thing but if they won't then I guess we'll see them in court. I get diminishing returns, but I'm working on the replacement costs. I have to replace the truck or sell my trailer. I should not lose a dime on this as I was sitting there minding my own business when it happened. Plus their client blew .16 which is drunk twice. Even the OJ jury could get this one right.
