Is personal use exempt from CDL?

Apparently some here think it is. What do you all think?

I would love to see the reasoning behind your thoughts.

Keep in mind I am not talking about RV's and Farm use here.

Is there a difference between state rules and federal rules?

Exemptions: Persons operating the following vehicles are exempt from a
Commercial Driver License (CDL):
1. A vehicle that is:
a. controlled and operated by a farmer;
b. used to transport agricultural products, farm machinery, or farm supplies
to or from a farm;
c. not used in the operations of a common or contract motor carrier; and
d. used within 150 miles of the person’s farm.
2. A fire-fighting or emergency vehicle necessary to the preservation of life
or property or the execution of emergency governmental functions, whether
operated by an employee of a political subdivision or by a volunteer fire fighter;
3. A military vehicle or a commercial motor vehicle when operated for military
purposes by military personnel, members of the Reserves and National
Guard on active duty, including personnel on full-time National Guard duty,
personnel on part-time training, and National Guard military technicians;
4. A recreational vehicle that is driven for personal use;
5. A vehicle that is owned, leased, or controlled by an air carrier, as defined
by Section 21.155 of the Transportation Code, and that is driven or operated
exclusively by an employee of the air carrier only on the premises of an airport,
as defined by Section 22.001 of the Transportation Code, on service
roads to which the public does not have access; or
6. A vehicle used exclusively to transport seed cotton modules or cotton
burrs.
the last thing i will say about this is that using your logic that personal vehicles are not exempt from a CDL. You must have a CDL to drive to the grocery store.

The exemptions listed are exemptions from needing a CDL to drive a CMV. Personal vehicles are ALWAYS exempt from requiring a CDL while being used for personal use, but they are not exempt from their respective license classes.

As far as picking and choosing, I used the part of the definition that pertains to licensing and registration. "Commerce, traffic, and transportation" collectively as pertaining to driving and licensing, are defined as the movement of goods and services within or across state lines.


Powerstroke72, I'm done. If I said anything in the other thread that could have been construed as an insult, I'm sorry. I was trying to just absorb the ones that came my way, but don't always do that well.

You would if driving a straight truck with a GVWR over 26k to the grocery store.

Why do you suppose that personal use is explicitly exempt from part 390 (USDOT#) and not from part 383(CDL)?

When a Moderator closes a thread due to arguments, personal attacks and/or other violations of the FTE guidelines, that doesn't mean you can simply start another thread in an attempt to continue the argument. You need to take a clue from the fact that the Moderator closed the other thread in the first place. This thread is now closed as well, if this continues infractions will be issued.

There's nothing wrong with arguing...people disagree, that's perfectly normal. But when it stoops to personal attacks, as it did in he other thread then you force us to step in and clean up your mess.
