Modeling for gym/weight loss center add (wife): Should she get paid?
My wife did some amazing weight loss and muscle building in the past year. The gym where she works out wants to use pics of her in their advertising, she has agreed. They have no intention to pay her for this, and its so flattering that she is just going to do it. Should she get paid for this? Or, is it common practice to do it because it is such a compliment? Anyone have experience with this? opinions?
i would think a discount at least, i certainly would not do advertising for free for a profit company. she is just helping make them money with nothing given in return.
not only should she get paid but she should also sign a written contract that does not allow the gym to use her image or words for anything without her approval, and they are not allowed to sell the image.. one minute shes a poster girl for the gym next minute you see her face or body photoshopped into another ad for something else

What ranger bob said. Your wife's gym will be making $$$$$$ off of HER hard work and determination.
Her pic could end up anywhere and maybe another ad agency might see her and want to use her for other legitimate modeling. If SHE does not think about these things you can be sure the GYM'S AGENTS will.
Thats what marketing is all about. If she does choose to take the pics, then those pics will be making the gym money (allowing more members to sign up). So she needs some of the cash. It wont be hurting the gym at all to give her some money for the photo shoot. They will make that money back in a matter of no time. Especially if they market the pics right.
Just My 2 cents, Have you wife go ahead with the pics as she agree, she can ask for the pics to start a portfolio, Then go to a modeling agency use the Quality pic's that the Gym payed for and get started on her new modeling career!
If I were her, I would ask for an agreement to sign that stipulates: 1. Use of the photo must be pre-approved by her for the ad; 2. no one else can use the picture whatsoever without her written approval, and 3. she should either get some monetary payment or free gym membership. Let's face it, she is helping the gym to prosper, so why shouldn't she prosper also?
The free or at least discounted membership and the written agreement to the rights of use of her pictures should be given. However she should explain the reasons so that there won't be any misunderstanding especially with the pictures.
i would never give out the rights to any pictures without a written agreement first. i would go see a lawyer about it before doing anything. jmo

Where is the advertising going to be? The city newspaper, or widely distributed periodicals like Shape or the National Enquirer?
This is a local gym, right? This isn't Golds, Curves, Total Fitness, or any other national chain, right? Try for a little freebie, but if you start asking for contracts and bringing in lawyers, it's going to be someone else's picture they'll be using.
