Dunno Shawn, but they once claimed that it was my fault that I got rearended by a truck driver for stopping at a yellow light. Their reason was that within a mile I had changed lanes which somehow apparently made it my fault that the other driver did not wish to obey the law.

I will get it back as long as he still has insurance. I tried going through his insurance first so that I would not have to pay out myself. After getting jerked around by them after getting the information that they asked for, I turned it into mine so that it would get done and let my company deal with his.

in VA whoever hits you in the rear is at fault... dunno how NC is with their laws yet...

Well NY is a no fault state. I am sure that if I was sitting in it even with it being legally parked, his insurance would have said that I was partially at fault. Luckily, I was in my office and one of the Buildings and Grounds guys came in to tell me that it looked like it was hit. The B&G guys were moving stuff out of the building before we moved.

I can say in MA its usually that way, but I actually got out of one once because the other driver was being an idiot lol. Used Car and Driver reviews to proove my point too. Insurance company was shocked that someone would actually dig out the specs from indipendent experts (As I called Car & Driver as well as Motor Trend) and did the math to prove that the scenario the other driver put forth was not possible. Got me covered and I didnt have to pay out the deductible as they determined because of it that it was his driving that caused the accident.

No fault still should have sidded with you not paying, even if you were in the truck as you would have simply argued that your vehicle was in the park gear and therefore not in a travel mode.

Jim I am sure that they would have but it would have given the other guys company something to argue.

yup.... i got the FICM and the Alt back in.. was in the process of running the EGT probes through the firewall when the clouds opened up and just poured...
