Well 2 sides to this, first she was pretty stupid for doing it (but some people really are innocent enough to not think along those lines, my wife would be one to carry real oregano in a plastic baggie, actually she did when her sister that grows herbs gave her some). But I would seriously have to question the "preliminary field tests" as in someone looked at it and said "yep positive it's opium or cocaine" because there is no other explanation for testing postive when the later test showed NO traces of drugs I.E. someone didn't evne bother just said they did. and this is a huge example of violation a persons rights... kept for 3 weeks on this charge? come on a lab could have definitive proof positive either way in 48hrs there is virtually no excuse for that. But then again I guess thats why they settled out of court, they got caught at a game they play all the time. You can bet if she had any money that they confiscated it won't be returend except through that law suit.

you are really on this whole getting shot deal today...its ok it made me laugh when i read your post...
when i was 17 i too some dried grass and put it in a baggie and drive around with it on my passenger seat.(back then i got pulled over about 2 or 3 times a month, junky car in nice area) the cop was not to happy with me, nor was my mom...but didnt go to jail for 21 days, but could see how it could happen. but for $180,000 i might spend 21 days in jail? well maybe not i would get traded like money!

This is one of the few times that I agree with a lawsuit. Three weeks in jail for carrying flour is insane. She apparently had no record, and she was not really trying to conceal anything. Whoever did this couldn't hold down Barney Fife's job.
I have a great deal of respect for cops, and I think that they have an awfully tough job, but come on.
