Just received a letter from my attorney regarding the accident I had back in April, and he tells me the driver who hit me, has hired his own attorney, and is disputing the damages, and his liability for them. The insurance company is not interested in settling out of court, so it is going to trial. The bad news is, they won't even set a trial date until February 27th, of next year, and it will be anywhere from 12-15 months after that. So, sometime in 2013 I'll be able to benefit from all this pain and suffering he has caused by running that stop sign.
So, no Ford trucks for at least 15-18 months, unless a miracle happens and they do decide to settle out of court, or I can find a job, and buy one that way. Also, I am still not able to walk normally, although I have done some walking without the walker, so that is an improvement. My attorney tells me that the other side may videotape me outside my home in an attempt to discredit my claims. Hoping to catch me running, or something. Not going to happen, since this is a real injury and not a made up one. Anyway, just wanted to let you know what is going on here. I will talk to the couple who is selling the truck and 5th wheel tomorrow when I go see it, maybe they will hold it, or let me me make payments on it when I get a job or something. I can't tell you how mad this news makes me. I am so tired of not being able to drive anywhere and having to rely on the bus, or the wheelchair. Too bad I can't sue them for the added pain and suffering of waiting 18 months.
Thanks. Just really makes me mad when I was expecting a settlement in a month or two, and now I have to wait 12-18 months. And what makes it worse, is the fact that there is nothing I can do to speed up the process.
It sounds like a common statedgy hoping that you will become desperate and accept a low-ball offer. If they are making you wait, you should wait the little extra time and go to jury. The people on the panel will see through their effrts to slow the process. Good luck, Jag
Sorry to hear about all the problems you're having...Especially with the insurance company. I was thinking exactly what Jag said...They're trying to wait you out. I hope you can hang in there and take 'em to trial.

Thanks. I understand the insurance company's point of view, if they wait 18 months to pay me, they have 18 months of interest on the money. However, Since I have to wait 18 months, and I know I have a good case, I am going to sue for the maximum. Before I was just interested in getting the medical/attorney bills paid, now I want something extra for my pain and suffering, since this move by them has added to that.
