I need a Lawyer or paralegal
 

I am having a problem with a neighbor. He has been caught in my back yard a couple of times. He insists that it is common area and he has the right to be there. It is not though. Also the last time he was looking in my slidding glass door. I called the police and they made an incident report. I sent a letter to the association and they kicked him off the board. Now I just got a letter from his atorney. It said a bunch of mumbo jombo that did not mean much to me but I don't want him to have the last word. I can't have him thinking that he has me running scared. He is in the wrong and I am in the right. I am renting my house and he is an owner. He HATES renters and thinks I am a lower form of life. This guy will come onto my property during the day when he thinks I am not home and "clean it up" I had a crock pot on my front step and it sat there for 2 days while we were gone. When we got home it was in the trash. I know it was him... anyway, I want to send a letter back to him as a "legal" answer to the one he sent me. I MUST have the last word.

Any help guy's?

Set up a motion capture camera, then have him arrested for trespassing. Make sure you put up a video surveillance sign.

Thought about it however, I think he is done doing it now. Since he knows im not going to take it. My wife about beat him down in the street when she caught him looking in. I just want to get the last word in. I cant have him think that his high priced lawyer is too good for me. I want to have an attorney send the same threat style letter to him.

There are multiple steps I would take in this situation:

- Notify your landlord
- Speak with the county mounties about the issue.
- Get a restraininng order, if you feel it is necessary.
- Contact a paralegal for advice

Personally, I would tell the SOB to get out of my face!...I would suggest that he could do things legally or have my Winchester up his ....Dress?

Well thats wshat I want the letter to say. His letter says he is prepared to defend himself vigirously. I want mine to say that I am prepared to defend my family and land vigirously according to the 2nd

he has made no threats but he is a nosey old man and he thinks im a piece of crap and because i rent I cannot afford a home. I am trash in his eye's

I agree with Ford_Six and PlacerMike. I usually handle neighbors the wrong way with a gun but that's retarded. I think they gave good advice. Do it legally and if you need me to I'll read up on my law books to help. And MARTY's, it does not make you less of a person for renting.

Legal Zoom might be able to draw you up a letter stating you are prepared to file legal action if he keeps on comming in. You could also claim through a paralegal (go to your local courthouse to find one) that he is a "peeping" tom and that your wife and yourself feel at risk when he his staring through the window and you do not know his intentions. If he enters your home a gun is permitted, but your land is a harder buy for courts. Also Marty, pay for the letter from any attorney and if He takes it farther where you need that attorney, sue him for all the cost and time this has taken from your life, and work.

I know people liket hat, when I lvied in california my parents rented a condo, I used to play guitar in the garage, and the guy one time opened the garage door saw him walk to his mailbox then he came and opened the door from the inside of the house, when I asked him how he got in, he said the door was un locked..which it wasnt we basically got a couple months rent free

But draw up a letter and if it goes any farther where you need to be paying an attorney sue him for all the cost, and a little extra for the time it has taken from your work, and possibly putting you behind bills. I hope it works out

Also, BTW... Two good points. If he is looking through your back door that's a peeping tom. And B.) even if your renting, that's your property. You have a right to protect it.

Hey< a little off subject Marty. You already know I'm a Comp. Scientist so you need help with hooking up some cameras I help too. But for the fun of it.... I just started junk in 5 more states. I thought it might make you laugh at least.

A no contact/restraining order issued by the court might wake him up better than a pee'n contest between lawyers.

Owned or rented makes no difference. It is your home...period. It should be respected as such.

Per WA RCW's, even your landlord cannot come onto the property without your permission, except in emergency circumstances. For all intents and purposes, while you are renting, you are the holder of that property.
I ran into this problem with my former landlord, they would actually walk right into the house if you didn't answer the door in about three seconds.

A renter has many rights, property lines are your domain; see if these legal sites have anything for your situation
