Local guy busted for making bio diesel
 
It was in the local paper that a man 20 miles from me got busted for making bio diesel on his property. They dismantled the machine and confiscated it. I think I read he received a $2000 fine. Nice huh?? He stated he is going to appeal the decision.

What were the charges because making BD is not illegal.
Running it on the road without paying road taxes is illegal but then so is running WVO.

Actually in some areas that may not be true, you are working with dangerous chemicals and fire hazards, plus dangerous fumes can emit so in some municipalities having quantities of flammable liquids like methonal is illegal without a permit. As well as some places would consider that commercial use of property or some other zoning law restriction (heck we aren't allowed to have a rabbit or chicken etc here, but I can brew biodiesel. :-X03 ) it all depends on the city he is in and what types of zoning restrictions they have. Some of those laws were put into affect to give a way to bust meth labs for having dangerous chemicals stored.

Running untaxed fuel is illegal in all states and federally.

There is an ethenol plant which just got started and they had about a 1 year process just for permits and environmental surveys

I remember reading about a guy in VA that got busted last year for selling homemade Bio Diesel. Got in trouble because of the fuels Tax. The state shut him down as I recall.

I think he would have been ok if he was just using it himself.

Do we need to be concerned with paying road tax for BD we make for PERSONAL use or not. Just one more pain in the a... with the Govt.

Ask Fab what is required to sell BD, its an almost impossible task. additionally the various state and federal agencies involved get upset if you dont ask them for permission.

I believe I was told or read you can make up to 400 gallons for personal use. I think im talking out my own hinee though.

I believe your going to start seeing more and more of this type of thing, you will start seeing restrictions on buying lye or KOH, or having methanol etc. Politicians and the government in general hates seeing someone getting away with not paying them what they seem to think is their birth right or or due. The government be it local, state or federal will be seeing this is a source of revenue and going after it trust me.
