My '09 6.4 has the same hesitation from a stop. I've put it down to turbo lag and the emissions controls. With the Smog goons here in CA, plus getting the Extended Warranty for the power train when I bought the truck, I'll just live with it.
With a 6.4, any visible smoke is enough reason for the CHP to check you out, or Joe Citizen to call the 1-800 smog number to report you.
Sad, but true.
Well I have only gotten 1 of those letters before and that was on my 01 and that thing is almost like 24/7 Dumping smoke. I think that most of the cops around here are chill and in this truck it will not be dumping smoke all the time so I think I will be good.

Well the other day I called Spartan tuner direct and I talked to Donna and she was very easy to talk to but she said that she was out of the DPF/CAT delete pipes so she said she would see what she could do for me and about 30 minutes later Sean from Street Diesel Performance gave me a call back and told me that Donna called him and he said that he would give me the same deal that I was getting from Donna. I also told him that I need it by thursday because I am going to RiffRaft Diesel tech day and I want to install it up there and do a couple passes down the drag strip. So he drop shipped the S&B filter from the factory in california and he is on his dime express shipping the tuner out here on monday so that I can get it loaded and ready to go and my Delete pipe should be here on Wednesday. So I just wanted to that Donna and Sean a bunch for making this happen can't wait to get it in and installed

But beware...it was completely legal for your '01 to dump smoke everywhere, as they didn't come with a DPF from the factory. You should be aware that it is against federal law to tamper with them, and with the new trucks it is VERY easy to catch.
All the cop has to do is recognize it's an '08 and see the smoke, and that's all they need. ANY black smoke coming from an '08 means that either it's been tampered with intentionally, or something is broken. Either way, he'd have probable cause to stop you and cite you for it. As part of the Clean Air Act, they can impose up to a $10,000 fine for tampering with a federally required emission component.
Now I'm no tree hugger...and even if I was one diesel particulate matter doesn't stay in the air to pollute, so I have never seen a problem with trucks without DPFs. However, as a commercial truck driver I know that the People's Republic of Kalifornia is VERY strict on diesel engine emissions...far more so than any other state. So in any other state I doubt you'd be hassled...
Make sure the benefit is worth the risk...

I think I will be playing it safe and not dumping smoke every where. Also because I bought the truck used I can say it came like that because the cat/ muffler was already taken off before I bought it.

Don't worry about "dumping smoke everywhere", the spartan only smokes on the 275 race tune and it's only real noticeable when you stand on it, and then it's a smoke show! Just use common sense and stay off of it in town and if you see a cop play it smart. I find it hard to believe that the california police have nothing better to do than chase tuned diesels around. Every time I see a semi they're usually pouring smoke out, leave the little guys alone and go after them. Heck, half the fun for me is knowing I'm breaking the law, but I'm in wisconsin, nobody cares around here. Good luck with your spartan, you won't believe the difference it's going to make!

benmodero, believe me they waste no time going after big trucks out there. I drive a tractor-trailer and I make every attempt to stay OUT of Kailfornia because of the ruthless enforcement out there. See, my truck is an '06 Kenworth which does not comply with EPA '07 emissions. Therefore, if I idle more than 5 minutes in Kalifornia, I am subject to a $300 minimum fine. If I get caught again, the fine will be between $1,000-10,000. Just for running my A/C to get a good night's sleep! Believe me, if they'll risk everyone's safety by interrupting me getting a good night's sleep for the sake of pollution, they WILL ruthlessly enforce their other diesel emissions laws...
With that state resorting to paying their bills with IOUs, I don't put much past them...

got a point there, I forgot they were flat broke. And seeing as though the fines are so high, they probably give out as many tickets as they can. Glad I'm in cow country!
Yeah, I live in Ohio for the moment, and this state is pretty lax when it comes to that stuff. Not much to worry about if I were to ditch my DPF, but I'm still really hesitant to do so. Makes me nervous with the heavy fines they can impose if I were to get caught.
I don't need or even want more power. I just want to get better than 15 MPGs!

yeah they really dont mess with us much down in Mississippi either. Most of our cops personal vehicles smoke worse than ours haha i dont think they even know about emissions laws around here

Now I don't want to start a fight here and I am not a lawyer. I did however work for the federal govt for 40 years and I read govermenteeze pretty well. I would like you to cite me a reference for that statement because I can't find it. I'm not saying it's not true because I don't know. But I can't find any federal code (law) that prohibits a "non-commerical" interest from modifying a diesel vehicle. Further, I can't imagine a local or state LEO enforcing a federal code. Most of the auto pollution codes I'm able to find are state laws and are based on if you did or didn't pass a state emmisions test. Now, when you get into commerical vehicles that's a whole different deal but even that stuff is mostly enforced by the state DOT. Anyway, I've been researching for a week or more now and I can't find it so please point me in the right direction. Thanks
