I mean if he had it coming off his lips and a big puff of smoke as he coughed up a lung --then they got him!!! if not let him alone! we have all made funny gestures for a picture! just look at Dave trying to pinch my butt! or the beer can on the truck-hey funny pictures!

 

I can't say as he was smoking but I can't say he wasn't either but do know anyone that just holds a bong Jr? I rather think with what I've heard he was smoking it but he didn't inhale.
