Exclamation New laws in CA and what Virgina is trying to pass

on edit: false info below, disregard...so says snopes...

New Driving Fines for 2007

1. Carpool lane - 1st time $1068.50 starting 7/1/07 (The $271 posted
on the highway is old). Don't do it again because 2nd time is going to be
double. 3rd time triple, and 4th time license suspended.

2. Incorrect lane change - $380. Don't cross the lane on solid lines or intersections.

3. Block intersection - $485

4. Driving on the shoulder - $450

5. Cell phone use in the construction zone. - Double fine as of 07/01/07.
Cell phone use must be "hands free" while driving.

6. Passengers over 18 not in their seatbelts - both passengers and drivers get tickets .

7. Speeders can only drive 3 miles above the limit.

8. DUI = JAIL (Stays on your driving record for 10 years!)

9. As of 07/01/07 cell phone use must be "hands free" while driving.
Ticket is $285. They will be looking for this like crazy - easy money for police department.

Check out what VA is trying to pass:

Virginia Introduces $3550 Speeding Ticket
Virginia legislator introduces new speeding ticket tax that boosts penalties beyond $3550, driving business to his traffic law firm.

Virginia motorists convicted of minor traffic violations will face a new, multi-year tax beginning July 1. Led by state Delegate David B. Albo (R-Springfield), lawmakers slipped a driver responsibility tax into a larger transportation funding bill signed by Governor Tim Kaine (D) in April. Albo, a senior partner in the Albo & Oblon, LLP traffic law firm, can expect to see a significant increase in business as motorists seek to protect their wallet from traffic tickets that come with assessments of up to $3000 in addition to an annual point tax that tops out at $700 a year for as long as the points remain.

"The purpose of the civil remedial fees imposed in this section is to generate revenue," the new law states. (Virginia Code 46.2-206.1)

Driving as little as 15 MPH over the limit on an interstate highway now brings six license demerit points, a fine of up to $2500, up to one year in jail, and a new mandatory $1050 tax. The law also imposes an additional annual fee of up to $100 if a prior conviction leaves the motorist with a balance of eight demerit points, plus $75 for each additional point (up to $700 a year). The conviction in this example remains on the record for five years.

Other six-point convictions include "failing to give a proper signal," "passing a school bus" or "driving with an obstructed view." The same $1050 assessment applies, but the conviction remains on the record for eleven years.

Although the amount of the tax can add up quickly, the law forbids judges from reducing or suspending it in any way. The tax applies only to Virginia residents, so that out-of-state motorists only need to pay the regular ticket amount. Michigan, New Jersey, New York and Texas also impose a somewhat more modest driver responsibility tax which they apply to out-of-state residents.

Hm, seems to me that our governing bodies are starting to get a little out of control with some of their "laws." Especially the ones that benefit their pockets.

And they claim this is the land of the free. I am not saying break the law, but come on guys, the penalties need to be reasonable, not ridiculous.

I see nothing wrong with the CA laws except the seat belt law and the 3 mph over. My thing is is that seat belts should be optional. Just like helment laws. By the way I wear my seat belt. I just think that Gov. shouldn't have to make it mandatory.

Can you post the citation from Snopes? (I'm looking and can't find it.)

The circles in which I move will have a field day with this....

The hands free cell phone law for California is true, but it doesn't take affect until July 2008.

Even if it does come true, there is always the election.

My local paper ran an article on the Virginia laws so I assume they must be legit. We'll see how long they last.

I posted the virginia law a little while back and it was reported that snopes said it was false, but the link they gave was for a different state. I searched and found several links for stories that said it was true. I searched snopes for virginia traffic and found no mention of the story. Unless I can find a valid link that says it is a urban legend I would keep my speed down.

The new VA laws go into effect tomorrow, local papers have been reporting on them over the last week or so. Washington Post had a article on them today in the Metro section

Some of them are
anyone under the age of 18 can't use a cell phone while driving.

driving on a suspended or revoked license 250 each year for 3 years
reckless or aggressive driving 350 each for 3 years
DUI 750 each for 3 years

the above fees are in addition to the regular fines for the ticket. Also these additional fines only apply to VA residents, out of staters get off with just the regular ticket price. Should be interesting to see how long these additional fees state in place.

Also just noticed for the first time that our registration fees are also going up cars under 4k will now be 39.50 a year, over 4k 44.50

The Virginia laws are true, but only for in-state drivers. That's a load of BS. Well, we already got rid of one of the "architects" of this bill in the Republican primary.

Sounds like Virginia is trying to out do Kalifornia as the number one Police state.
