ok, so heres the deal guys. I bought an old truck, but the guy has lost the title somewhere. He went to DMV to get a new one, but dmv says that theres a lien against the truck....from 1976. The scoop is, the guy I'm buying the truck from paid it off in 18 months (1977), but because DMV's records do not show it being paid off, they wont give him the clear title to sell it to me. Also, the kicker is, the Babbitt Ford Employee Credit Union he bought it from in Arizona has been out of business for about 15 or so years.
Anyone have any ideas how to get around this? I want the truck, nay, I'm keeping the truck no matter what, but how can we get around it?

Does he have anything legal showing it paid off that can be used in a court? If so then I would talk to a lawyer. Not sure what type of lawyer but a lawyer. Unfourtunally that cost money. Worse case can you get another 76 and use one for parts and the other for VIN #.

 

no, he doesn't. And thats the problem. DMV would probably give him the title if he could come up with proof that the lien has been taken off, but he doesn't have anything because he naturally thought that it was taken care of 28 years ago.

 

Ouch. Sorry but I havent a clue other than another 76. Someone might have another idea.

 

Whats the process of obtaining a title to a truck that is made entirely of parts? Hopefully there wouldnt be any inspections and I could pass it off as a truck made from parts? Just a thought, theres got to be some loop hole, eh?

if he gets pulled by the police and the plates and title dont match the vin number , Which is actually found in two places on that truck,the truck will be impounded, bob

 

how many times have you been pulled over where they checked more then the vin plate?

I would guess that a credit union that has been out of business for 15 years could not collect on a lien even if the truck had not been paid off. I would approach the DMV with the fact that there is no one to collect on the lien. Ask them just who the lien is suppose to be paid to. If they can tell you who to pay then you can go to them for proof that the lien was paid many years ago. I would think that someone took over the credit unions loans when they went out of business.

 

he could do a storage lien on the truck for himself and get a title that way ,
Ive done them and ,its only a registered letter to the last known owner , that dmv could give him and the fees to be paid , which isnt much. all dmv wants is a paper trail to cover themselves with,bob
